<br />services for the authority and shall provide such notices <br />as may be required of the city by state liquor and beer <br />laws and this Code. <br /> <br />5.08.130 Powers of the Authority. <br /> <br />A. The authority shall have all the powers possible of <br />a local licensing authority as set forth in Title <br />12, Articles 46, 47, and 48, C.R.S., as from time <br />to time amended, and in this Code. <br /> <br />B. The authority may promulgate rules and regulations <br />concerning the procedures for hearings and the <br />presentation of evidence at hearings. <br /> <br />C. The authority may, consistent with state law and <br />this Code, grant, approve, renew, or refuse <br />licenses for the sale at retail of malt, vinous, <br />and spirituous liquors; conduct investigations as <br />are required by law; suspend or revoke such <br />licenses for cause; and levy penalties, sanctions, <br />or other conditions against licensees or managers <br />in the manner provided by law. <br /> <br />D. The local licensing authority shall have the <br />authority, through its secretary, to issue <br />subpoenas to require the presence of persons and <br />the production of papers, books, and records <br />necessary to the determination of any hearing which <br />the local licensing authority is authorized to <br />conduct. It is unlawful for any person to fail to <br />comply with any subpoena issued by the secretary of <br />the local licensing authority. <br /> <br />section 4. If any portion of this ordinance is held to be <br />unconstitutional or invalid for any reason, such decision shall not <br />affect the validity or constitutionality of the remaining portions <br />of this ordinance. The City Council hereby declares that it would <br />have passed this ordinance and each part hereof irrespective of the <br />fact that anyone part be declared unconstitutional or invalid, <br /> <br />section 5. The repeal or modification of any provision of <br />the Municipal Code of the City of Louisville by this ordinance <br />shall not release, extinguish, alter, modify, or change in whole or <br />in part any penalty, forfeiture, or liability, either civil or <br />criminal, which shall have been incurred under such provision, and <br />each provision shall be treated and held as still remaining in <br />force for the purpose of sustaining any and all proper actions, <br />suits, proceedings, and prosecutions for the enforcement of the <br />penalty, forfeiture, or liability, as well as for the purpose of <br /> <br />6 <br />
