<br />TO SERVE EACH LOT; EACH LOT WILL MEET THE <br />REQUIREMENTS OF THE CITY'S ZONING REGULATIONS <br />WITHOUT THE NECESSITY FOR A VARIANCE; NO <br />VARIANCE HAS BEEN GRANTED WITHIN THE THREE (3) <br />PREVIOUS YEARS TO ANY LOT; AND, NO PART OF THE <br />SUBDIVISION HAS BEEN APPROVED AS PART OF A <br />MINOR SUBDIVISION WITHIN THREE (3) YEARS <br />PRIOR TO THE DATE OF THE SUBMISSION OF THE <br />MINOR SUBDIVISION PLAT. <br /> <br />4. THE SUBDIVISION IS OF A LOT, PREVIOUSLY <br />CREATED BY AN APPROVED FINAL SUBDIVISION PLAT, <br />WHICH IS SPLIT OR SUBDIVIDED INTO NO MORE THAN <br />TWO LOTS AND THE LOTS CREATED BY THE SPLIT <br />COMPLY WITH THE APPLICABLE DIMENSIONAL <br />REQUIREMENTS OF THE CITY'S ZONING REGULATIONS. <br /> <br />Section 3. Section 17.28.210 of the Louisville Municipal <br />Code is amended to read as follows (words to be added are <br />capitalized) : <br /> <br />17.28.170 Application -- Review. <br /> <br />B. PRIOR TO SUBMISSION OF THE PRELIMINARY DEVELOPMENT <br />PLAN TO THE PLANNING COMMISSION, THE SUBDIVIDER <br />SHALL PRESENT THE PRELIMINARY PLAN TO THE CITY <br />COUNCIL FOR INFORMAL REVIEW AT A REGULAR MEETING OF <br />THE COUNCIL. THIS INFORMAL REVIEW IS TO PROVIDE <br />THE OPPORTUNITY FOR INFORMATION EXCHANGE AND <br />DIALOGUE BETWEEN THE CITY COUNCIL AND THE APPLICANT <br />CONCERNING CITY DEVELOPMENT GOALS AND OBJECTIVES. <br />NO ACTION SHALL BE TAKEN BY THE CITY COUNCIL ON THE <br />PRELIMINARY PLAN AS PART OF THIS INFORMAL REVIEW <br />OTHER THAN TO TRANSMIT THE PRELIMINARY PLAN TO THE <br />PLANNING COMMISSION NOR SHALL THE CITY COUNCIL BE <br />BOUND BY ANY DISCUSSION OR COMMENTS DURING THE <br />INFORMAL REVIEW. Within sixty days after filing a <br />complete application and any required materials, <br />the planning commission shall provide notice as <br />required under Section 17.04.070, hold a public <br />hearing and approve, disapprove or approve with <br />conditions the preliminary development plan. <br /> <br />Section 4. Section 17.28.210 of the Louisville Municipal <br />Code is amended to read as follows (words to be added are <br />capitalized; words to be deleted are stricken through): <br /> <br />17.28.210 Amendments to final plan. <br /> <br />No changes may be made in an approved final plan <br />PRIOR TO OR during the construction of the planned unit <br /> <br />3 <br />
