<br />C. PRIOR TO SUBMISSION OF THE PRELIMINARY PLAT TO THE <br />PLANNING COMMISSION, THE SUBDIVIDER SHALL PRESENT <br />THE PRELIMINARY PLAT TO THE CITY COUNCIL FOR <br />INFORMAL REVIEW AT A REGULAR MEETING OF THE <br />COUNCIL. THIS INFORMAL REVIEW IS TO PROVIDE THE <br />OPPORTUNITY FOR INFORMATION EXCHANGE AND DIALOGUE <br />BETWEEN THE CITY COUNCIL AND THE SUBDIVIDER <br />CONCERNING CITY DEVELOPMENT GOALS AND OBJECTIVES. <br />NO ACTION SHALL BE TAKEN BY THE CITY COUNCIL ON THE <br />PRELIMINARY PLAT AS PART OF THIS INFORMAL REVIEW <br />OTHER THAN TO TRANSMIT THE PRELIMINARY PLAT TO THE <br />PLANNING COMMISSION, NOR SHALL THE CITY COUNCIL BE <br />BOUND BY ANY DISCUSSION OR COMMENTS DURING THE <br />INFORMAL REVIEW. The preliminary plat shall be <br />submitted to the planning commission and a public <br />hearing shall be held on said plat. Notice of the <br />time and place of the public hearing shall be sent <br />as required by the statutes of the state. <br />Additionally, notice of the public hearing shall be <br />published in a newspaper of general circulation <br />within the city at least five days prior to such <br />hearing. <br /> <br />Section 2. Section 16.12.110. C of the Louisville Municipal <br />Code is amended to read as follows (words to be added are <br />capitalized; words to be deleted are stricken through) : <br /> <br />16.12.110 Minor subdivision procedure. <br /> <br />C. A SUBDIVISION APPLICATION <br />MEETING ONE OR MORE OF THE FOLLOWING CRITERIA SHALL <br />BE ELIGIBLE FOR REVIEW AS A MINOR SUBDIVISION: <br /> <br />1. THE SUBDIVISION CONTAINS SOLELY RESIDENTIAL <br />USE AND RESULTS IN NOT MORE THAN FOUR DWELLING <br />UNITS. <br /> <br />2. THE SUBDIVISION IS A REPLAT OF AN APPROVED <br />FINAL SUBDIVISION PLAT WHICH DOES NOT INCREASE <br />THE NUMBER OF LOTS OR INCREASE DENSITY, AND <br />WHICH DOES NOT RESULT IN A MATERIAL CHANGE IN <br />THE EXTENT, LOCATION, OR TYPE OF PUBLIC <br />IMPROVEMENTS, EASEMENTS, ARRANGEMENT OF <br />STREETS, OPEN SPACE, OR UTILITIES. <br /> <br />3. THE SUBDIVISION RESULTS IN NO MORE THAN TWO <br />(2) LOTS; EACH LOT IS ADJACENT TO AND HAS <br />ACCESS TO AN ACCEPTED AND MAINTAINED PUBLIC <br />STREET; THE IMPROVEMENTS REQUIRED BY CHAPTER <br />16.20 ARE ALREADY IN EXISTENCE AND AVAILABLE <br /> <br />2 <br />
