<br />OR ORDER AN ELECTION WITHIN SIXTY DAYS AFTER THE VACANCY <br />OCCURS, IT SHALL ORDER AN ELECTION AS SOON AS PRACTICABLE <br />TO FILL THE VACANCY UNTIL THE TERM OF OFFICE OF A <br />SUCCESSOR ELECTED AT THE NEXT REGULAR ELECTION HAS <br />COMMENCED AS PROVIDED IN SECTION 31-4-105, C.R.S., AS <br />AMENDED FROM TIME TO TIME. <br /> <br />2.36.040 Conduct in accordance with state law. <br /> <br />All elections shall be held and conducted in <br />accordance with the Colorado Municipal Election I:.aw CODE, <br />EXCEPT THAT ALL COORDINATED ELECTIONS, AS DEFINED IN <br />STATE LAW, SHALL BE HELD AND CONDUCTED IN ACCORDANCE WITH <br />THE UNIFORM ELECTION CODE OF 1992, AS AMENDED FROM TIME <br />TO TIME, AS SHALL ANY OTHER ELECTION WHEN SO PROVIDED BY <br />RESOLUTION OF THE CITY COUNCIL. <br /> <br />2.36.050 Write-in candidates. <br /> <br />In any municipal CITY election HELD AND CONDUCTED IN <br />ACCORDANCE WITH THE MUNICIPAL ELECTION CODE, no write-in <br />votes for any municipal office shall be counted unless an <br />affidavit of intent has been filed with the city clerk by <br />the person whose name is written in prior to ~ TWENTY <br />days before the date of the election. The affidavit of <br />intent shall indicate that such person desires the office <br />and is qualified to assume the duties of that office if <br />elected. IN ANY CITY ELECTION HELD AND CONDUCTED IN <br />ACCORDANCE WITH THE UNIFORM ELECTION CODE OF 1992, THE <br />AFFIDAVIT OF INTENT SHALL BE FILED AS REQUIRED BY THAT <br />CODE, AS AMENDED FROM TIME TO TIME, MORE THAN TWENTY-FIVE <br />DAYS BEFORE THE ELECTION. <br /> <br />2.36.060 Canceling of election. <br /> <br />A. In a municipal CITY election HELD AND CONDUCTED <br />UNDER THE MUNICIPAL ELECTION CODE, if the only <br />matter before the voters is the election of persons <br />to office and if, at the close of business on the <br />FRIDAY NINETEENTH DAY before the election, there <br />are not more candidates than offices to be filled <br />at such election, including candidates filing an <br />affidavit of intent as set forth in Section <br />2,36.050, the city clerk shall certify such fact to <br />the city council. The city council shall then hold <br />a meeting and may cancel the election and by <br />resolution declare the candidates elected, and upon <br />such declaration by the city council the candidates <br />shall be deemed elected.
