After the applicant was issued a permiton September 13, 2012, constructionbeganon the <br />house. Initial plumbing inspections were completed by the Louisville Building Safety <br />Division in the middle of November 2012. On March 21, 2013 the Louisville Building <br />Safety Division completed a foundation inspection. Although the permitstated the <br />applicant was to provide written verification from a registered surveyor which demonstrated <br />the foundation was formed in conformance with setback requirements, the letter was not <br />provided, and the Louisville Building Safety Divisiondid not require it be provided before <br />approval of the foundation inspectionwas issued. <br />After receiving foundation approval, the applicant began the vertical construction of the <br />house. Insulation approval was issued on March 29, 2013 and framing and drywall <br />inspections were approved on April 4, 2013. Final inspection of the home was completed <br />on October 21, 2013 by the Chief Building Official. <br />At thetimeof final inspection, the applicant provided an Improvement Survey Plat which <br />showedthe surveyed location of the home. Upon reviewing the Plat, it became clear the <br />home was located within the required front setback. Specifically, the stone columns <br />supporting the second and third story porch/overhang were located 19 feet from the front <br />property line (encroaching 6 feet into the front setback), and the foundationofthe house <br />was located 23.5 feet from the front property line (encroaching 1.5 feet into thefront <br />setback). Any structure which is taller than 30 inches above grade is requiredto meet <br />setback requirements. The columns of the house, the second and thirdstory decks, and <br />the house itself all must comply with the setback requirements. <br />When it became clearfrom the Improvement Survey Platthe home was located in the front <br />setback, staff notified the applicant a variance from the Louisville Board of Adjustment <br />(BOA)would be required before a Certificate of Occupancy could be issued. <br />The following timeline provides an overview of the permit and inspection process: <br />September 13, 2012 – Permit Issued <br />November 13,14, 27 - Plumbinginspected and approved. <br />March 21, 2013 – Poured concrete foundation work inspected and approved <br />(survey letter not provided) <br />March 29, 2013 – Insulation inspected and approved <br />April 4, 2013 – Framing and drywall inspected and approved <br />October 21, 2013 – Final inspection <br />October 21, 2013 – Improvement Survey Plat provided to staffshowing <br />encroachment into front setback. <br />As demonstrated by this timeline, inspection approvals were issued by the Louisville <br />Department of Planning and Building Safety without first obtaining a letter from a <br />professional surveyor demonstrating the foundation was located in conformance with the <br />setback requirements. <br />3 <br />
