On September 13, 2012 the applicants were issued a building permit to construct a new <br />single family home on a vacant lot at 169 S. Roosevelt Ave. The building permit, which <br />was reviewed, approved, and issuedby the Louisville Department of Planning and Building <br />Safety, depicted a single family home with second and third story front porches supported <br />by vertical stone columns.The main body of the house was shown on the permit to be set <br />back 27 feet from the front (eastern) property line, and the stone columns supporting the <br />porcheswereshownlocated 25 feet from the front property line. The eave of the home <br />was shown to extendone foot six inches into the required setback (23 feet 6 inches from <br />the front property line). The Louisville Municipal Code permits eaves and other <br />architectural features to project up to three feet into any required yard. The location of the <br />home and front porch as shown in the permit met all of the setback requirements of the <br />Bella Vista South PUD. <br />Anotice was placedon the plan set which stateda wet stamped letter from a registered <br />surveyor would be required in conjunction with thefoundation inspection verifyingthe <br />foundation had “ <br />been formed in compliancewith all applicable Building Code and Zoning <br />.” The following image includes the site plan from the building <br />Code setback requirements <br />permit and the above referenced stamped note. <br />2 <br />
