On September 13, 2012 the applicants were issued a building permit to construct a new
single family home on a vacant lot at 169 S. Roosevelt Ave. The building permit, which
was reviewed, approved, and issuedby the Louisville Department of Planning and Building
Safety, depicted a single family home with second and third story front porches supported
by vertical stone columns. The main body of the house was shown on the permit to be set
back 27 feet from the front (eastern) property line, and the stone columns supporting the
porcheswereshownlocated 25 feet from the front property line. The eave of the home
was shown to extendone foot six inches into the required setback (23 feet 6 inches from
the front property line). The Louisville Municipal Code permits eaves and other
architectural features to project up to three feet into any required yard. The location of the
home and front porch as shown in the permit met all of the setback requirements of the
Bella Vista South PUD.
Anotice was placedon the plan set which stateda wet stamped letter from a registered
surveyor would be required in conjunction with thefoundation inspection verifyingthe
foundation had “
been formed in compliancewith all applicable Building Code and Zoning
.” The following image includes the site plan from the building
Code setback requirements
permit and the above referenced stamped note.
2
