Louisville City Council Meeting <br />August 20, 2002 <br />Page 11 <br /> <br />reviewed this matter on July 9, 2002 and has forwarded a recommendation of support for <br />the vacation of said easements and right-of-way. <br /> <br />Wood reviewed the request for a Revocable License Agreement between the City of <br />Louisville and PorterCare Adventist Health System on Tract A. He stated Tract A is ten <br />acres parcel, which has been conveyed to the City as a condition of the Avista Adventist <br />Annexation and the US 36 Comprehensive Development Plan IGA. The applicant is <br />requesting a license agreement to conduct grading and limited farming, and to install <br />drainage and maintain easements for existing and proposed utilities. The applicant does <br />not propose to landscape Tract A, but wants to maintain its existing monument sign. <br /> <br />Wood stated Staff supports the license agreement, as it is important to allow the applicant <br />to conduct transition grading between the golf course and the development site in a <br />manner, which appears natural and enhances the screening of the westerly parking lots <br />from US 36. <br /> <br />Wood reviewed the reconsideration of Ordinance No. 1380, Series 2002, approved on <br />March 19, 2002, and authorized the zoning of a 13.23-acre parcel to (PCZD-C). The <br />purpose of the reconsideration of the Avista zoning ordinance is to re-approve the <br />ordinance with a revised legal description, as the prior legal description included a 0.25- <br />acre parcel owned by CDOT. Wood addressed the required setbacks from US 36, and <br />stated Staffs position that the conditions of the General Development Plan would remain <br />intact and would not be influenced or modified. Setbacks for US 36 are 100' for all <br />parking and site improvements and 200' for structures. <br /> <br />Wood addressed the reconsideration of Resolution No. 19, Series 2002, Avista Adventist <br />Hospital, approved by Council on June 4, 2002. The resolution authorized a Final PUD <br />Development Plan for the Avista Adventist Hospital Professional Office Building II and <br />the Ambulatory Surgical Center. The purpose of the reconsideration is also to re-approve <br />Resolution No. 19, Series 2002 with a revised legal description. <br /> <br />Davidson called for Applicant presentation. There was no Applicant presentation. <br /> <br />Davidson asked Avista Hospital CEO John Sackett, for permission to tap their water line <br />for a fire hydrant, without cost recovery, in exchange for granting Avista's request that <br />their monument sign remain in Tract A. <br /> <br />Sackett voiced his agreement with the exchange. <br /> <br />Mayer referred to the error on CDOT land, and asked if the setbacks were in error. <br /> <br />Wood stated that in the GDP, the setbacks were based on US 36. He explained there is a <br />100-foot setback from US 36 for parking and site improvements, a 200-foot setback for <br />structures, and from the south property line, a 50-foot setback for buildings. <br /> <br />11 <br /> <br /> <br />
