Louisville City Council Meeting <br />August 20, 2002 <br />Page 10 <br /> <br />Planning Director Paul Wood asked if Council wished to have the presentation cover <br />Agenda Items 7C through 7G concerning Avista Adventist Hospital. <br /> <br />Davidson asked that the presentation include all the items concerning Avista Hospital. <br /> <br />Director Paul Wood reported the applicant is requesting authorization of a Final <br />Subdivision Plat to be known as Health Park Subdivision Filing No. 6. The proposed plat <br />functions as both a replat of Filing No. 5, as well as to bring a recently annexed parcel <br />into the holdings of PorterCare Adventist Health Systems. The total area of the <br />subdivision plat is 66.29 acres. The purpose of the plat was to replat the existing Filing <br />No. 5, and to incorporate the recently annexed parcel. <br /> <br />Wood explained Tract A was conveyed to the City as a condition of both the recent <br />Avista Adventist Annexation and the US 36 Comprehensive Development Plan IGA. As <br />Tract A is being dedicated to the City of Louisville, the applicant has submitted a license <br />agreement request to conduct certain activities, which requires Council authorization. <br /> <br />Wood addressed the historic access, which is currently provided through the Health Park <br />Campus to the US 36 underpass for the Superior Cemetery. The Town of Superior had <br />responded to the project referral that the cemetery access be considered as part of a <br />regional recreational trail connection. The applicant desires to preserve the historic right <br />of access for the cemetery, but does not support, at this time, an expanded use of the <br />easement as a potential recreational trail. The applicant is requesting that a note be added <br />to the subdivision plat, which restricts the use of the access easement solely for the <br />purposes of cemetery access, and not for general public use. He noted that was not a <br />condition of approval, as the Planning Commission did not support the easement being <br />further restricted by a note. The Planning Commission forwarded a recommendation of <br />support for the Final Subdivision Plat with the following conditions of approval: <br /> <br />Prior to the issuance of an overlot-grading permit, the owner shall receive <br />Council authorization to conduct any activity within Tract A and shall execute <br />a license agreement in connection with such activities. <br /> <br />2. Prior to, or in conjunction with plat recordation, the owner shall execute and <br /> record an amended Health Park Subdivision Agreement. <br /> <br />3. The applicant shall provide evidence of "permission to grade" from CDOT <br /> prior to commencing off-site grading. <br /> <br />Wood reviewed Ordinance No. 1398, Series 2002, if authorized, approves the vacation of <br />certain easements and street fight-of-way within the Health Park Subdivision. He stated <br />there are 9 different easements in Health Park Subdivision Filing No. 6, being requested <br />for vacation, as well as the City's fight-of-way. The applicant is requesting this action as <br />the subject easements/right-of-way are not needed, or are being relocated as they conflict <br />with existing and or proposed structures.
