Louisville City Council Meeting
August 20, 2002
Page 9

Davidson called for a recess at 8:30 p.m., and reconvened the meeting at 8:35 p.m.

Council member Levihn returned to the meeting.

RECONSIDERATION OF ORDINANCE NO. 1395, SERIES 2002 - AN
ORDINANCE SUBMITTING TO THE REGISTERED ELECTORS AT THE
NOVEMBER 5, 2002, SPECIAL ELECTION A BALLOT ISSUE CONCERNING
CONTINUATION OF THE CITY SALES AND USE TAX FOR OPEN SPACE
ACQUISITION, DEVELOPMENT, MAINTENANCE AND RELATED
PURPOSES

Davidson called for Staff presentation.

Deputy City Manager Julie Boyd explained the ordinance was approved setting ballot
title language for the continuation of the open space sales and use, however, the phrase
"and for all other lawful municipal purposes" was added to the end of the description of
what the revenues can be used for. This language does not reflect Council's intent, which
is to use the revenues collected from the tax to fund the acquisition of open space land,
and to allow use of some of the funds for the construction, development and maintenance
of projected located on open space land and parks. Notice was published on August 16
stating the ordinance would be reconsidered by the City Council with the specific change.

Davidson opened the public hearing and asked if anyone in the audience wished to speak
for or against Ordinance No. 1395, Series 2002. Hearing none, Davidson closed the
public heating.

City Attorney Light noted that the ballot title had one word missing. He requested that
the word "and" be inserted, on line 10, after FUTURE PARKS. He asked that the motion
include the correction of the ballot title.

MOTION: Mayer moved that Council reconsider Ordinance No. 1395, Series 2002, as
amended, seconded by Brown. Roll call vote was taken. The motion passed by a vote of
6-0. Keany absent.

AVISTA ADVENTIST HOSPITAL

Davidson called for Staff presentation.

Sisk recused himself from the discussions and voting of all the Avista Hospital agenda
items. He explained that his wife is a member of the Avista Hospital Board of Directors.

Davidson asked that the record reflect that Council member Sisk was excused from the
discussions and voting on the Avista Hospital matters.

9
