The animal control officer shall comply with <br />applicable provisions of state law upon impounding <br />any livestock. <br /> <br />Section 6.12.120 <br /> <br />Impoundment redemption fees. <br /> <br />Any owner of an impounded animal may redeem the <br />animal from impoundment upon payment of impoundment, <br />boarding, inoculation or veterinary fees, and any other <br />expenses incurred by the city or the animal shelter in <br />connection with the impoundment of the animal and its <br />subsequent care. The amount of any city impoundment fees <br />shall be as determined by resolution or motion of the <br />city council from time to time. <br /> <br />Section 6.12.130 <br /> <br />Length of impoundment. <br /> <br />A. Impoundment shall be for a period of time <br />determined by the operator of the pound, but in no <br />event less than five (5) days, unless earlier <br />claimed upon payment of all requisite fees as set <br />forth in Section 6.12.120. If a complaint has been <br />filed in municipal court pursuant to Section <br />6.12.020, concerning vicious animals, or Section <br />6.12.150, concerning wild, exotic, or dangerous <br />animals, the complaint must be resolved prior to <br />any delivery of the animal to the owner. Animals <br />not claimed within such time shall become the <br />property of the city and may be disposed of by such <br />means, as determined by the city administrator or <br />the administrator's designee. <br /> <br />B. I f an animal is impounded, the animal control <br />officer or police officer may institute proceedings <br />in the municipal court against the owner, if known, <br />charging the owner with a violation of this title. <br />Nothing in this title shall be construed as <br />preventing the animal control officer, a police <br />officer, or a complaining citizen from instituting <br />a proceeding in the municipal court for violation <br />of this title where there has been no impoundment. <br /> <br />c. The refusal to redeem any impounded animal by the <br />owner thereof shall not relieve the owner of the <br />duty to pay the impoundment, boarding and <br />veterinary charges that may be assessed.
