<br />10-<6 <br /> <br />E. Schools, parks, churches and other community <br />facilities should be planned for as an integral <br />part of the area to the extent possible. Open <br />space, park, and recreation areas must be located <br />in such a manner as to create an area that is <br />usable and accessible to the residents of the <br />subdivision and shall otherwise conform to all <br />applicable city standards and requirements. The <br />need for additional open space, park, and <br />recreation areas shall be based on the following <br />factors: the city's comprehensive plan; <br />topography, drainage, vegetation and other physical <br />conditions; the type and density of the proposed <br />development; the availability of other open space, <br />park and recreation areas; and the overall need <br />within the proposed development for such areas. <br /> <br />F. Development shall proceed in such phases or stages <br />so as to assure the timely availability of public <br />services to the subdivision and its future <br />residents and the orderly development of the <br />subdivision. <br /> <br />G. The remaining design standards of this chapter and <br />the improvement requirements of Chapter 16.20 must <br />be met. <br /> <br />Section 7. This Ordinance shall take effect as provided in <br />Section 9 and shall apply as follows: <br /> <br />A. Sections 1 through 6 of this Ordinance shall apply to any <br />sUbdivision for which no preliminary plat has been approved on the <br />effective date of this Ordinance. <br /> <br />B. For any subdivision, the preliminary plat of which has <br />been approved by the Planning Commission prior to the effective <br />date of this Ordinance but the final plat of which has not been <br />approved by the City Council, Sections 1, 4, 5, and 6 of this <br />Ordinance shall apply to the final plat approval, and the final <br />plat shall address the matters described in Section 3 of this <br />Ordinance. <br /> <br />Section 8. If any portion of this ordinance is held to be <br />unconstitutional or invalid for any reason, such decision shall not <br />affect the validity or constitutionality of the remaining portions <br />of this ordinance. The City Council hereby declares that it would <br />have passed this ordinance and each part hereof irrespective of the <br />fact that anyone part be declared unconstitutional or invalid. <br /> <br />8 <br />
