<br />If-lS" <br /> <br />allowed by law without disclosing any confidentiality or any matter <br />which would negatively affect the interests of the city and shall <br />announce what procedure, if any, will follow from the executive <br />session. <br /> <br />2.90.090 Authorized topics. <br /> <br />Topics which may be discussed in an executive session shall be <br />limited to the following: <br /> <br />A. Matters where the information being discussed is required to <br />be kept confidential by federal or state law; <br /> <br />B. Personnel matters involving the dismissal, demotion, <br />discipline or review of the performance of employees directly <br />appointed by the council, consideration of complaints or <br />charges against employees appointed directly by the council, <br />and other personnel matters only upon request of the city <br />administrator or mayor for information only; <br /> <br />C. Consideration of water rights and real property acquisitions <br />and dispositions by the city, but only as to appraisals and <br />other value estimates and strategy for the acquisition or <br />disposition of such rights or property. <br /> <br />D. Consultation with attorneys representing the city with respect <br />to pending litigation. Pending litigation shall include cases <br />wherein a lawsuit is actually commenced, and any situation <br />where the person requesting the executive session believes in <br />good faith that a lawsuit may result. The council may discuss <br />settlement strategies in an executive session. <br /> <br />2.90.100 Authorized participants. <br /> <br />A. The mayor and all councilmembers shall be entitled to <br />participate in all portions of all executive sessions. In <br />addition, the city administrator, any attorney representing <br />the city, the city clerk, the city treasurer, and department <br />heads shall be authorized to participate in an executive <br />session, unless excluded by a majority vote of the council <br />during the public portion of the meeting. In addition, the <br />council may allow any other person to participate in an <br />executive session if the name of the individual is made part <br />of the initial request hold the executive session. <br /> <br />B. If during an executive session, the council may desire the <br />presence of any additional person in the executive session, <br />then the council shall reconvene in open session, announce the <br />name of the individual, and upon a two-thirds vote of the <br />membership approving such participation, shall return to the <br />executive session with the additional person in attendance. <br /> <br />15 <br />
