Legal consultation with an attorney representing <br />the city with respect to pending litigation." <br /> <br />2.90.060 Two-thirds vote required. <br /> <br />The executive session shall only be held upon an affirmative <br />vote of two-thirds of the entire membership of the Council. A <br />separate vote shall be held on each topic requested to be <br />considered in the executive session. Following the vote and <br />immediately prior to retiring into the executive session, the mayor <br />shall announce the topic or topics of the executive session. <br /> <br />2.90.070 Procedures while in session. <br /> <br />A. Immediately upon retiring into the executive session, the <br />requesting party shall explain in detail the nature of the <br />topic and the reasons for requesting the executive session. <br />At this time, those in attendance may discuss the propriety of <br />the executive session. <br /> <br />B. Before any discussion on the merits of any topic in the <br />executive session, the city attorney shall give an opinion as <br />to the propriety of the executive session and shall provide <br />guidelines as to the parameters of the discussion. <br /> <br />C. At any time, any councilmember may object to the continuation <br />of the executive session. Upon the making of such objection, <br />all discussion shall cease and the council shall reconvene in <br />an open session for the purpose of determining the propriety <br />of continuing the executive session. An affirmative vote of <br />two-thirds of the membership of the council shall be required <br />to continue the executive session. Nothing in this subsection <br />shall allow a councilmember to obj ect repeatedly to the <br />continuation of the executive session solely for the purpose <br />of delaying or impeding the discussion of an appropriate topic <br />in executive session. <br /> <br />D. Councilmembers shall not take any official action, nor take <br />any "straw" or informal vote, in an executive session. <br />However, nothing in this subsection shall prohibit any person <br />from fully expressing his or her opinion on any subject <br />properly under discussion. <br /> <br />2.90.080 Procedure upon completion. <br /> <br />Upon completion of the executive session, the council shall <br />reconvene in an open session.
