<br />(p-s <br /> <br />Administrator, which property is thereafter unclaimed by <br />the owner pursuant to this Chapter, the finder of record <br />shall be notified in writing that the finder has twenty <br />(20) days to claim the property found. If the finder, <br />within such twenty-day period makes a request for the <br />property, the property shall be given to the finder. If <br />no such request is made, the property shall then become <br />the sole property of the City. <br /> <br />9.90.060 Unauthorized removal of property. <br /> <br />It is unlawful for any person to remove any property <br />from out of the custody and possession of any City <br />custodian of property without having first obtained a <br />release of said property from the custodian. This <br />section shall apply to all persons irrespective of <br />ownership or any claim or right any person may have with <br />respect to such property. <br /> <br />section 2. The City Council herewith finds, determines, <br />and declares that this ordinance is necessary for the immediate <br />preservation of the public health and safety in order to ensure <br />that a comprehensive City procedure for the disposition of <br />unclaimed property is effective in a timely manner, and this <br />ordinance shall take effect upon adoption and signing by the Mayor <br />if approved by three-fourths of the members of the City Council. <br /> <br />Section 3. If any portion of this ordinance is held to be <br />unconstitutional or invalid for any reason, such decision shall not <br />affect the validity or constitutionality of the remaining portions <br />of this ordinance. The City Council hereby declares that it would <br />have passed this ordinance and each part hereof irrespective of the <br />fact that anyone part be declared unconstitutional or invalid. <br /> <br />section 4. The repeal or modification of any provision of <br />the Municipal Code of the City of Louisville by this ordinance <br />shall not release, extinguish, alter, modify, or change in whole or <br />in part any penalty, forfeiture, or liability, either civil or <br />criminal, which shall have been incurred under such provision, and <br />each provision shall be treated and held as still remaining in <br />force for the purpose of sustaining any and all proper actions, <br />suits, proceedings, and prosecutions for the enforcement of the <br />penalty, forfeiture, or liability, as well as for the purpose of <br />sustaining any judgment, decree, or order which can or may be <br />rendered, entered, or made in such actions, suits, proceedings, or <br />prosecutions. <br /> <br />section s. All other ordinances or portions thereof <br />inconsistent or conflicting with this ordinance or any portion <br />hereof are hereby repealed to the extent of such inconsistency or <br />conflict. <br /> <br />5 <br />
