City Council Meeting Minutes December 3, 2013 Page 12 of 21 Planning Director Russ noted the ordinance deals with quasi - judicial issues and not the comp plan, small area plans or legislative matters, as they operate by different rules. He welcomed City Council input and public comments on the public notice process. City Manager Fleming stated the City will include notices in the City newsletter, which goes to every Louisville resident. He stated there are multiple ways of providing notice. Council member Stolzmann stated if the ordinance is approved it will be a clerical update. She felt it is important to follow -up with additional meetings to expand the public communication process. Council member Keany asked for confirmation from the City Attorney if a quasi - judicial process is posted, the requirements cannot be changed because it would be unfair to the project. City Attorney Light stated if the ordinance is approved it will not dictate the size; the Planning Director will make that judgment. The Council can amend the ordinance to require more notice, which may create problems of preferential treatment. He stated this ordinance sets the minimum requirements to establish jurisdiction to conduct a public hearing. This does not preclude notices via the website or a communication plan or other technology. He felt the more subjectivity was introduced in the ordinance the more the risk the legal notice process becomes an issue of dispute. Planning Director Russ explained an action less than 500' is the minor plat. Council member Lipton felt the spirit of the motion to approve was for the Council to revisit the notice process. Mayor Pro Tem Dalton agreed the ordinance sets the minimum requirements to establish jurisdiction and a communication plan can be reviewed at another time. Council member Lipton stated the ordinance sets the legal minimums and the communication of notices can be revisited later. Mayor Muckle agreed and suggested revisiting a communication plan. VOTE: All were in favor. Absent: Council member Jasiak. APPROVAL TO ADD DECEMBER 11, 2013 FROM 5:30 — 10:00 PM TO THE DECEMBER 9, 2013 AND DECEMBER 10, 2013 SPECIAL MEETING FOR THE PURPOSE OF CONDUCTING BOARD AND COMMISSION INTERVIEWS Council member Stolzmann recommended amending the agenda title to reflect the December 11th date will be the discussion and selection of the board and commission members and be open for public comment. Mayor Pro Tem Dalton stated it is not necessarily a selection meeting. Council member Stolzmann felt it is a special meeting and should be advertised as a public meeting to allow public comment.
