City Council <br />Meeting Minutes <br />December 3, 2013 <br />Page 12 of 21 <br />Planning Director Russ noted the ordinance deals with quasi - judicial issues and not the <br />comp plan, small area plans or legislative matters, as they operate by different rules. <br />He welcomed City Council input and public comments on the public notice process. <br />City Manager Fleming stated the City will include notices in the City newsletter, which <br />goes to every Louisville resident. He stated there are multiple ways of providing notice. <br />Council member Stolzmann stated if the ordinance is approved it will be a clerical <br />update. She felt it is important to follow -up with additional meetings to expand the <br />public communication process. <br />Council member Keany asked for confirmation from the City Attorney if a quasi - judicial <br />process is posted, the requirements cannot be changed because it would be unfair to <br />the project. <br />City Attorney Light stated if the ordinance is approved it will not dictate the size; the <br />Planning Director will make that judgment. The Council can amend the ordinance to <br />require more notice, which may create problems of preferential treatment. He stated <br />this ordinance sets the minimum requirements to establish jurisdiction to conduct a <br />public hearing. This does not preclude notices via the website or a communication plan <br />or other technology. He felt the more subjectivity was introduced in the ordinance the <br />more the risk the legal notice process becomes an issue of dispute. Planning Director <br />Russ explained an action less than 500' is the minor plat. <br />Council member Lipton felt the spirit of the motion to approve was for the Council to <br />revisit the notice process. <br />Mayor Pro Tem Dalton agreed the ordinance sets the minimum requirements to <br />establish jurisdiction and a communication plan can be reviewed at another time. <br />Council member Lipton stated the ordinance sets the legal minimums and the <br />communication of notices can be revisited later. Mayor Muckle agreed and suggested <br />revisiting a communication plan. <br />VOTE: All were in favor. Absent: Council member Jasiak. <br />APPROVAL TO ADD DECEMBER 11, 2013 FROM 5:30 — 10:00 PM TO THE <br />DECEMBER 9, 2013 AND DECEMBER 10, 2013 SPECIAL MEETING FOR THE <br />PURPOSE OF CONDUCTING BOARD AND COMMISSION INTERVIEWS <br />Council member Stolzmann recommended amending the agenda title to reflect the <br />December 11th date will be the discussion and selection of the board and commission <br />members and be open for public comment. <br />Mayor Pro Tem Dalton stated it is not necessarily a selection meeting. Council member <br />Stolzmann felt it is a special meeting and should be advertised as a public meeting to <br />allow public comment. <br />
