Louisville City Council Meeting <br />December 2, 2003 <br />Page 13 of 22 <br /> <br />Council member Brown asked if STK submitted a second comp plan. Wood responded <br />no. <br /> <br />Council member Brown asked City Attomey Light for his legal opinion that STK did not <br />submit a second comp plan. City Attorney Light voiced his opinion that the Planning <br />Commission has the authority to propose modifications. He stated the modifications <br />were not treated as a new application and did not require another 90-day waiting period. <br />Light recommended the additional ten day notice be Published and additional public <br />hearings be conducted to provide sufficient time for public comment on the revised <br />language. He did not believe the 90-day notice was subject to the public hearing process. <br /> <br />Council member Brown asked if the City has the authority to conduct an open house for <br />public discussion. Light stated the City has the authority to conduct open houses and <br />may also conduct additional sessions, which would be part of the public hearings process. <br /> <br />Council member Keany asked if the properties located on the east side of STK were <br />annexed by Broomfield prior to the 1994 South Sub-Area property and were included in <br />the plan. Wood stated the action statements relative to the Southwest Quadrant were <br />specifically limited to the Northwest Parkway. He was not aware of whether Broomfield <br />had annexed the property to the east. City Attorney Light voiced his belief the area was <br />annexed in 1996 by Broomfield. <br /> <br />Council member Keany stated his recollection that the property in the 1994 South Sub- <br />area envisioned a buffer for Louisville on the west side of 96th Street. Wood stated there <br />were different assumptions in the 1998 South Sub-area amendment. <br /> <br />Council member Keany asked for confirmation the comp plan change does not guarantee <br />residential development in the area. Wood confirmed the statement. Wood stated the <br />City Council could amend the zoning without support of a comp plan. <br /> <br />Council member Van Pelt had questions for Finance Director Charlene Laus relative to <br />the fiscal analysis. She asked for confirmation the analysis provides for full build out <br />over a 20-year period. Laus stated the analysis proposes construction in 2006 and build <br />out over a 20 to 25-year period. <br /> <br />Council member Van Pelt asked if there was any analysis for less than full build out or <br />that incorporates timing of the development and the interim impacts in ten years. Laus <br />stated the applicant would propose build out in less than 20 years, but the 20-year <br />analysis is more conservative. <br /> <br />Council member Marsella asked if the public was given the oppommity to give input at <br />the Planning Commission public hearings. Wood stated there was ample opportunity for <br />the public to comment. <br /> <br />13 <br /> <br /> <br />
