Louisville City Council Meeting December 2, 2003 Page 13 of 22 Council member Brown asked if STK submitted a second comp plan. Wood responded no. Council member Brown asked City Attomey Light for his legal opinion that STK did not submit a second comp plan. City Attorney Light voiced his opinion that the Planning Commission has the authority to propose modifications. He stated the modifications were not treated as a new application and did not require another 90-day waiting period. Light recommended the additional ten day notice be Published and additional public hearings be conducted to provide sufficient time for public comment on the revised language. He did not believe the 90-day notice was subject to the public hearing process. Council member Brown asked if the City has the authority to conduct an open house for public discussion. Light stated the City has the authority to conduct open houses and may also conduct additional sessions, which would be part of the public hearings process. Council member Keany asked if the properties located on the east side of STK were annexed by Broomfield prior to the 1994 South Sub-Area property and were included in the plan. Wood stated the action statements relative to the Southwest Quadrant were specifically limited to the Northwest Parkway. He was not aware of whether Broomfield had annexed the property to the east. City Attorney Light voiced his belief the area was annexed in 1996 by Broomfield. Council member Keany stated his recollection that the property in the 1994 South Sub- area envisioned a buffer for Louisville on the west side of 96th Street. Wood stated there were different assumptions in the 1998 South Sub-area amendment. Council member Keany asked for confirmation the comp plan change does not guarantee residential development in the area. Wood confirmed the statement. Wood stated the City Council could amend the zoning without support of a comp plan. Council member Van Pelt had questions for Finance Director Charlene Laus relative to the fiscal analysis. She asked for confirmation the analysis provides for full build out over a 20-year period. Laus stated the analysis proposes construction in 2006 and build out over a 20 to 25-year period. Council member Van Pelt asked if there was any analysis for less than full build out or that incorporates timing of the development and the interim impacts in ten years. Laus stated the applicant would propose build out in less than 20 years, but the 20-year analysis is more conservative. Council member Marsella asked if the public was given the oppommity to give input at the Planning Commission public hearings. Wood stated there was ample opportunity for the public to comment. 13
