Louisville City Council Meeting <br />December 2, 2003 <br />Page 12 of 22 <br /> <br />Mayor Pro Tem Sisk asked if StorageTek has removed the east-west connection between <br />96 Street and 88 Street. Wood stated that any development ~n the area ~s reqmred to <br />provide a connection between 96th Street and 88th Street, however the location has shifted <br />diagonally from Tape Drive. <br /> <br />Mayor Pro Tem Sisk asked for the Planning Commission's justification for modifying <br />StorageTek's application for the comp plan amendment. Wood stated the Planning <br />Commission's attempt to modify the application built in the same levels of concern <br />relative to traffic impact, transit, and level of service for intersections. <br /> <br />Council member Brown asked for background information about the 1998 Comp Plan <br />amendment. Wood stated there were two amendments in 1998. One amendment dealt <br />with land use, and added a policy focusing on the alignment of the Northwest Parkway <br />and areas of state interest. The second amendment initiated the 96th Street/Highway 42 <br />connection, and provided a policy for that road construction. <br /> <br />Brown asked why the South Sub-Area plan was adopted when the 1989 Comprehensive <br />Development Plan was in place. Wood stated it was not specific Council direction, <br />however, in his capacity as Planning Director he evaluated the 1989 Comp Plan and <br />determined an amendment and a set of policies was required to review the South Sub- <br />Area. He noted the South Sub-Area Plan did not repeal the 1989 Comp Plan. <br /> <br />Council member Brown stated his understanding there was a comp plan in place but not <br />specific to the South Sub-area. He stated the issue is whether there should or should not <br />be residential development on the property. Wood stated the Planning Commission <br />deliberately separated the comp plan from the general development plan and brought <br />forward their recommendation for a higher level of criteria in terms of reviewing <br />residential development. <br /> <br />There was discussion relative to any possibility of STK de-annexing from City of <br />Louisville and annexing to the City and County of Broomfield. It was determined that <br />STK could not annex to the City and County of Broomfield without an amendment to the <br />state constitution. <br /> <br />Council member Brown requested clarification relative to the amendments to STK's <br />original application. Wood stated the original STK comp plan amendment was submitted <br />on May 12, 2003, and contained six elements. On October 14, 2003, the Planning <br />Commission made modifications to the application. The question was asked if <br />modification could be made without a 90-day holding period. Wood stressed the <br />modification does not constitute a new comp plan. He stated his concern centered on the <br />record reflecting sufficient evidence and testimony to support the revisions without <br />additional evidence in the record. The Planning Department proceeded with the <br />understanding the modifications were within the Planning Commission's ability to <br />modify without making substantial changes. <br /> <br />12 <br /> <br /> <br />
