Special Meeting Minutes <br />City of Louisville City Council & <br />Town of Superior Board of Trustees <br />December 16, 2013 <br />Page 2 of 10 <br />PUBLIC COMMENTS ON ITEMS NOT ON THE AGENDA <br />There were no public comments. <br />DISCUSSION ITEMS <br />Mayor Andrew Muckle welcomed the Louisville City Council and noted it was an <br />opportunity to meet with their neighbors. Mayor Robert Muckle voiced his hope the <br />meeting would clear up a lot of questions. <br />A. LOUISVILLE- SUPERIOR REVENUE SHARING IGA <br />Louisville staff presentation: City Manager Fleming explained in 1997 the City of <br />Louisville and the Town of Superior entered into an agreement to settle some long <br />standing issues within the community regarding US 36. It also provided a logical <br />boundary between the two communities and addressed the disconnection of the north <br />Louisville property and the south Superior property so those properties could be <br />managed by the respected communities on their side of US 36. It provided for sharing <br />50% of sales tax derived in those two areas at a rate of 2.7 %. <br />The IGA was amended in 2005 to provide the following provisions: The requirement <br />for the Town of Superior to provide a minimum of 250,000 square feet of retail, sales -tax <br />generating development on the South Property as part of its approval of the Preliminary <br />PD /Zone District Plan for the development on the South Property and Superior shall not <br />permit or approve any development that does not contain such minimum amount of <br />retail, sales -tax generating square footage. With such approval, Superior shall also <br />require a phasing plan requiring certificates of occupancy issued for at least 125,000 <br />square feet of retail, sales -tax generating development before certificates of occupancy <br />are issued for the more than 30 percent of the total number of permitted residential <br />dwelling units or 500 dwelling units, whichever is more, but not to exceed 700 dwelling <br />units. The IGA establishes a framework for revenue sharing on either side of the US <br />36 Highway. The 5 -acre parcel on the Louisville side and the 80 -acre parcel on the <br />Superior side are subject to the terms of the IGA. <br />The City of Louisville formally communicated their concerns about the proposed Town <br />Center Development and whether it complies with the terms of the IGA. The City of <br />Louisville is concerned about the issue and has not received a formal response from the <br />Town of Superior. The purpose of the meeting was to ascertain the Town of Superior's <br />intent to comply with the IGA and if the proposed development accomplishes <br />compliance. <br />COUNCIL /BOARD QUESTIONS COMMENTS <br />21 <br />
