Special Meeting Minutes <br />City of Louisville City Council & <br />Town of Superior Board of Trustees <br />December 16, 2013 <br />Page 3 of 10 <br />Mayor Andrew Muckle stated the proposed development fully complies with the IGA. <br />Mayor Robert Muckle noted the Town of Superior requested the amendment to the IGA <br />and inquired why the request was made. Mayor Andrew Muckle voiced his belief it was <br />because of transportation issues and the US 36 Interchange. <br />Council member Stolzmann noted the "Whereas" clauses in the Amended Agreement, <br />refers to adding a mixed -use development to entice retail development. <br />B. SUPERIOR TOWN CENTER APPROVED DEVELOPMENT PLAN <br />Superior presentation: Mayor Andrew Muckle reviewed the key components of the <br />Superior Town Center approved development plan through a land use map. The <br />development begins just south of Old Chicago, at the Ice Rink, with a proposed hotel <br />site. He noted the projection for sales tax development in the area far exceeds the <br />250,000 square feet and is within the 400,000 square foot range. The building adjacent <br />to the hotel is Ranch Sport, a 160,000 square foot building, which will generate 40,000 <br />square feet of retail sales tax. Other developments along McCaslin Boulevard will <br />generate retail sales tax in the Town Core. He noted more detailed architectural <br />drawings could be made available if the Council wishes. The residential section is <br />located on the south section, however there is some residential in the core, located <br />north of 3rd Street. Parking is accomplished through parking structures within the <br />development. He noted there will be floodplain mitigation because of Coal Creek. <br />COUNCIL /BOARD QUESTIONS COMMENTS <br />Mayor Pro Tem Dalton stated his understanding the flexible and commercial spaces are <br />not specified as retail and asked if not designated in the land use plan, it becomes a use <br />by right for commercial and would not require being reviewed by the Board of Trustees. <br />Mayor Andrew Muckle stated the PD does not provide a use by right. Mayor Pro Tem <br />Cirelli confirmed every portion of the development must come back before the Board for <br />approval. He explained the Board must be reasonable in the approval process and <br />consistent in the preliminary development, but nothing will go forward without the <br />Board's approval. <br />Mayor Andrew Muckle noted the Board cannot dictate what will happen and /or stipulate <br />exact types of retail uses. <br />Council member Stolzmann inquired if the commercial could be labeled retail on the <br />land use plan. Mayor Andrew Muckle stated they could, however the market may not <br />respond. They do not want to build retail that will remain vacant based on conditions of <br />approval. <br />22 <br />
