City Council <br />Meeting Minutes <br />December 17, 2013 <br />Page 13 of 24 <br />criteria for alcohol. Council changed the direction to match a size limitation closer to <br />medical marijuana. <br />Council member Lipton inquired about the current process of enlarging the store and <br />changing the location. Planner I Robinson stated it would require a modification of <br />premises or change location through the Local Licensing Authority. <br />Council member Loo asked for clarification on change of location. City Attorney Light <br />explained the moratorium ordinance amendment provides an opportunity for the existing <br />medical marijuana establishments to convert to retail at their current licensed locations. <br />The proposed ordinance does not allow changes of location. <br />Council member Loo agreed with Council member Keany the ordinance is in conflict <br />with itself. She supported 4,000 square feet for a dual operation. Mayor Pro Tem <br />Dalton was in favor 4,000 square feet for a dual license and relocating within the same <br />shopping center (Colony Square). <br />Council member Lipton did not want dual establishments to fail because they are <br />undersized, but felt the business should stay within the approximate location and area. <br />Council member Jasiak suggested 1,800 square feet for medical and 2,000 square feet <br />for retail. She agreed the intent of relocating is within the current shopping center. <br />Mayor Muckle requested Council comments on the recommendations suggested by the <br />health department. <br />Mayor Muckle and Council members Jasiak and Lipton expressed support for the health <br />department recommendations. <br />Mayor Pro Tem Dalton and Council members Keany and Stolzmann expressed <br />opposition to the health department recommendations. <br />Council member Stolzmann supported the establishment's location being within the land <br />use plan; 5,000 square feet for retail marijuana. <br />Council member Keany questioned the distance requirement for the change of location. <br />Planning Director Russ explained the land use does not allow marijuana establishments <br />along McCaslin. The only in -line shopping area available to a marijuana establishment <br />is Colony Square or across the street at Dillon and McCaslin. <br />Council member Jasiak requested Mr. Harmon provide background information on the <br />prohibition of logos. Mr. Harmon explained most of the research comes from alcohol <br />and tobacco. The promotional giveaways such as t- shirts, can be displayed near <br />schools providing opportunities for a youth to see, correlate and thus likely to use.
