Council member Lipton <br />suggested referring the question of scanners to the Local Licensing Authority. <br />ORDINANCE No. 1648, SERIES 2013 - AN ORDINANCE OF THE CITY OF <br />LOUISVILLE AMENDING THE TEMPORARY MORATORIUM ON THE <br />ESTABLISHMENT OR OPERATION OF RETAIL MARIJUANA <br />ESTABLISHMENTS WITHIN THE CITY — 2nd Reading — Public Hearing <br />The Council discussed amendments to Ordinance No. 1648, Series 2013 and there was <br />support for a change of location within 1/4 mile of their present establishment. City <br />Attorney Light recommended 1,320 feet. There was Council consensus. <br />City Attorney Light recommended a motion to adopt Ordinance No. 1648, Series 2013, <br />with the following second reading amendments: Addition to Section 1, Sub paragraph <br />1: "or premises within 1,320 feet of the aforementioned premises subject to compliance <br />with all applicable regulations ". Addition of sections 3 and 4 and a related Whereas <br />clause: which clarifies the moratorium extends to other forms of marijuana businesses <br />claiming not to be one of the four types of establishments recognized by the constitutional <br />amendment. <br />MOTION: Mayor Pro Tem Dalton moved to Ordinance No. 1648, Series 2013 on <br />second reading, with the amendments outlined by the City Attorney, seconded by <br />Council member Loo. Roll call vote was taken. The motion passed by a vote of 7 -0. <br />ORDINANCE No. 1649, SERIES 2013 - AN ORDINANCE AMENDING TITLE 5 OF <br />THE LOUISVILLE MUNICIPAL CODE TO ADOPT REGULATIONS <br />REGARDING BUSINESS LICENSING AND OPERATIONAL REQUIREMENTS <br />FOR RETAIL MARIJUANA ESTABLISHMENTS — 2nd Reading - Public <br />Hearing <br />The Council discussed amendments to Ordinance No. 1649, Series 2013. Mayor <br />Muckle and Council members Jasiak and Lipton supported the Health Department's <br />recommendations, with the exception of the scanners and a closing time of 8:00 p.m. <br />Mayor Pro Tem Dalton and Council members Stolzmann and Keany did not support the <br />Health Department's recommendations. <br />MOTION: Mayor Muckle moved to approve Ordinance No. 1649, Series 2013 on <br />second and final reading with the following amendments: 1,800 square feet for medical <br />marijuana establishments; 2,000 square feet for retail marijuana establishments; hours <br />of operation from 8:00 a.m. to 8:00 p.m. and the Health Department's recommended <br />options # 2, 4 and 5, seconded by Council member Jasiak. <br />City Attorney Light offered two friendly amendments to the motion: 1) Addition to Sec. <br />5.11.080 B to add the sentence: "The maximum physical space occupied by any <br />43 <br />
