"City": the City of Louisville, Colorado. d. "City Policy": refers to the Charter, Code, rules, regulations, standards and policies of the City, including; the City's Design and Construction Standards as may be applicable, as the same maybe amended from time to time. e. "Constructio:n Acceptance": construction acceptance of the Project by the City in accordance with Section 2.4 of this Agreement. f. "District": the C"olorado Tech Center Metropolitan District. g. "Engineering; anal Construction Phase": that phase of the Project more specifically addressed in Article 2 o:f this Agreement. h. "Final Acceptance": final acceptance of the Project by the City in accordance with Section 2.5 of this .Agreement. i. "Final Plans and Specifications": the plans and specifications for construction of the Project as designed a.nd approved by the City Engineer in accordance with City Policy. j. "Parties": refers jointly to the City and the District. k. "Project": the clew lift station and related improvements, including but not limited to the extension of gravity .sewer and force mains, as more specifically identified in Exhibit A. 1. "Reimbursement Fee": the fee to be imposed and collected by the City from properties located within the Benefited Area in accordance with Article 3 of this Agreement. m. "Reimbursement Phase": that phase of the Project more specifically addressed in Article 3 of this Agreerent. n. "Total Reimbursement Amount": means the Total Reimbursement Amount as set forth in Exhibit C attached hereto. ARTICLE 2 ENGINEERING AND CONSTRUCTION PHASE 2.1 Payments for En~ine;erin~ and Construction Costs. The District shall pay the Actual Capital Costs for the Project. T'he District shall maintain accurate records of the Actual Capital Costs incurred by the District for the Project.
