RESOLUTION NO. 6 SERIES 1992 A RESOLUTION APPROVING CERTAIN AGREEMENTS BETWEEN AND ACTIONS BY THE TOWN OF SUPERIOR, COLORADO, AND THE CITY OF LOUISVILLE, COLORADO WHEREAS, the Town of Superior (hereafter "superior") and the City of Louisville (hereafter "Louisville") entered into an agreement dated May 18, 1982, which addressed certain matters of sewage collection and treatment (hereafter" 1982 sewer agreement") ; and WHEREAS, Superior and Louisville entered into an agreement on July 28, 1982, which addressed certain matters of water treatment and supply (hereafter "1982 water agreement"); and WHEREAS, litigation between Superior and Louisville regarding the meaning of the 1982 sewer agreement and of the 1982 water agreement is pending; and WHEREAS, the Board of Trustees Council of Louisville believe it is in respective communities to mutually obligations of each to the other; and of Superior and the Ci ty the best interests of their determine the respective WHEREAS, Superior no longer desires to obtain water treatment and supply from Louisville and Louisville no longer desires to provide such treatment and supply to Superior under the terms of the 1982 water agreement; and WHEREAS, Superior and Louisville each recognize that it is in the best interests of their respective citizens to rescind the 1982 sewer agreement and enter into a new sewer agreement; and WHEREAS, Louisville recognizes that the pending litigation becomes moot upon rescission of the 1982 water agreement and the 1982 sewer agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. The Agreement attached hereto and incorporated herein by this reference rescinding the 1982 water agreement is approved and the Mayor is authorized and directed to execute the Agreement on behalf of the City of Louisville, subject to the condition described in paragraph 4 of this Resolution. 1
