<br />maintenance and repairs to the superior sewage collection system, <br />to the extent of Louisville's ability to do so, in the same manner <br />and to the same extent as Louisville provides routine maintenance <br />and repairs to Louisville's sewage collection system. Such routine <br />maintenance and repairs shall be made without additional charge to <br />Superior. Such routine maintenance and repairs shall not include <br />"replacements". For purposes of this Agreement, "replacements" <br />shall be defined as the installation of more than six feet of new <br />pipe at a single time. The Louisville City Administrator may agree <br />upon request of superior to provide other than routine maintenance <br />and repairs to Superior's collection system at the sole cost of <br />superior. Superior shall assure Louisville of legal access to the <br />Superior collection system at all times for the purpose of routine <br />maintenance and repairs. <br /> <br />16. Nothing herein shall be construed to prevent Superior <br />from establishing and enforcing rates, fees, and charges over and <br />above any amounts which superior may be required to pay to <br />Louisville pursuant to the terms of this Agreement. <br /> <br />17. Nothing in this Agreement shall be construed to prevent <br />Louisville from expanding, replacing, repairing, relocating, or <br />encumbering any portion of its sewage collection or treatment <br />system at any time and at Louisville's sole discretion at no <br />additional expense to Superior. <br /> <br />18. Nothing herein shall be taken or held as imposing upon <br />Louisville an obligation to effectively regulate or control any <br />user or property outside Louisville, it being intended by this <br />Agreement to give to Louisville a voluntary option to exercise <br />certain powers respecting users and property rather than imposing <br />upon Louisville an obligation to do so. <br /> <br />19. Superior and Louisville agree to obtain, and to <br />continuously maintain, general liability insurance, subject to <br />customary exclusions, for their respective sewer services and <br />systems ln the sum of at least $150,000.00 per person and <br />$400,000.00 per occurrence for any single incident, and to maintain <br />said insurance to meet the maximum limitations on judgments under <br />the Colorado Governmental Immunity Act, as amended from time to <br />time. Superior and Louisville shall each furnish the other with <br />copies of all liability policies purchased in compliance with this <br />term and shall cause the other to be named as an additional insured <br />on such policies. <br /> <br />20. Louisville shall cause any expansion to the Louisville <br />sewage treatment system financed by superior pursuant to paragraph <br />6 hereof to be insured in the same manner and to the same extent as <br />the remainder of the Louisville sewage treatment system. <br />Louisville shall use insurance proceeds received as a result of any <br />destruction of such expansion to replace such expansion. <br /> <br />9 <br />
