<br />WATER AGREEMENT <br /> <br />THIS AGREEMENT made and entered into this 21st day ot <br />Janua.ry , 1992, by and between the TOWN OF SUPERIOR, a <br />municipal corporation of the State of Colorado, hereinafter <br />referred to as "Superior", acting by and through its Mayor and Town <br />Clerk, upon the prior approval and authority of its Board of <br />Trustees, and the CITY OF LOUISVILLE, a municipal corporation of <br />the state of colorado, hereinafter referred to as "Louisville", <br />acting by and through its Mayor and City Clerk, upon the prior <br />approval and authority of its city council, <br /> <br />WI'1'NESSE'1'S: <br /> <br />WHEREAS, on July 28, 1982, superior and Louisville entered <br />into an Agreement whereby Louisville would treat and supply water <br />for Superior for specified fees; and <br /> <br />WHEREAS, superior has implemented and <br />supply and distribution system which <br />anticipated needs of the present and <br />superior; and <br /> <br />WHEREAS, superior no longer desires to obtain water treatment <br />and supply from Louisville; and <br /> <br />installed its own water <br />adequately meets the <br />future inhabitants of <br /> <br />.- <br />WHEREAS, Louisville and superior each recognize that it is in <br />its best interests to rescind the 1982 water Agreement; <br /> <br />NOW, THEREFORE, the parties hereto agree that the 1982 Water <br />Agreement is hereby rescinded in its entirety. <br /> <br />IN WITNESS WHEREOF, the parties have executed this Agreement <br />in duplicate original counterparts. <br /> <br />TOWN OF SUPERIOR, COLORADO <br /> <br />CITY OF LOUISVILLE, COLORADO <br /> <br />By: <br /> <br />-i:9d. -r t; $- <br /> <br />Mayor <br /> <br />By: ~ G~ <br />Mayor <br /> <br />(jST:. _. <br />~o/:~~ <br /> <br />ATTEST: <br /> <br /> <br />c:lv;lle\watragmt.fnl <br />
