Any modification of Exhibit 2 occurring as a result of actual monitoring shall occur no sooner than the forty-fifth day after the non-moni toring party is provided the results of the monitoring. .. << (6) Nothing in this Agreement shall be construed to prevent Louisville from expanding the capacity of its system at its sole option, nor to prevent Louisville and superior from jointly financing system expansions as the parties may agree. 7. The maximum expansion of the Louisville sewage treatment plant which may be requested by Superior pursuant to this Agreement, including system improvements pursuant to paragraph 6, is that necessary to generate up to a maximum instantaneous flow rate equivalent to 2.265 million gallons per day (1572.92 gallons per minute) of sewage capacity. 8. Superior will be solely responsible for acquiring in its own name any land and rights-of-way necessary for the installation of its contemplated collection system. All sewage collection lines and appurtenant facilities owned and operated by superior shall be constructed, installed, and replaced by Superior in accordance with the prevailing standards for like or similar installations now or hereafter applicable inside Louisville. The engineering plans and specifications for such facilities shall be subject to the review of and comment by the City Administrator of Louisville or the Administrator's authorized agent. Such engineering plans and specifications shall be approved if they conform to Louisville's then current sewer construction standards. superior shall reasonably consider any modifications requested by the City Administrator of Louisville or the Administrator's authorized agent. 9. The tracings, maps, and blueprints, including as-built drawings, and any other related materials, including specifications, of any part of the Superior sewage collection system shall be promptly furnished without charge to Louisville, no later than ninety (90) days after attachment of the facility. 10. Louisville will not perform engineering services for Superior but shall be entitled to review and comment on superior's plans for the sewage collection system and to inspect installations thereunder at all times at Louisville's own expense. 11. (a) superior shall allow no discharge to the Louisville sewage treatment system and Louisville shall have no obligation to accept any discharge which does not meet quality standards applicable within Louisville as adjusted from time to time.
