<br />applicable to the monitoring including, but not limited <br />to, the results of the monitoring. Any modification of <br />Exhibit 2 occurring as a result of actual monitoring <br />shall occur no sooner than the forty-fifth day after the <br />non-moni toring party is provided the results of the <br />monitoring. <br /> <br />.. <br /><< <br /> <br />(6) Nothing in this Agreement shall be <br />construed to prevent Louisville from expanding the <br />capacity of its system at its sole option, nor to prevent <br />Louisville and superior from jointly financing system <br />expansions as the parties may agree. <br /> <br />7. The maximum expansion of the Louisville sewage treatment <br />plant which may be requested by Superior pursuant to this <br />Agreement, including system improvements pursuant to paragraph 6, <br />is that necessary to generate up to a maximum instantaneous flow <br />rate equivalent to 2.265 million gallons per day (1572.92 gallons <br />per minute) of sewage capacity. <br /> <br />8. Superior will be solely responsible for acquiring in its <br />own name any land and rights-of-way necessary for the installation <br />of its contemplated collection system. All sewage collection lines <br />and appurtenant facilities owned and operated by superior shall be <br />constructed, installed, and replaced by Superior in accordance with <br />the prevailing standards for like or similar installations now or <br />hereafter applicable inside Louisville. The engineering plans and <br />specifications for such facilities shall be subject to the review <br />of and comment by the City Administrator of Louisville or the <br />Administrator's authorized agent. Such engineering plans and <br />specifications shall be approved if they conform to Louisville's <br />then current sewer construction standards. superior shall <br />reasonably consider any modifications requested by the City <br />Administrator of Louisville or the Administrator's authorized <br />agent. <br /> <br />9. The tracings, maps, and blueprints, including as-built <br />drawings, and any other related materials, including <br />specifications, of any part of the Superior sewage collection <br />system shall be promptly furnished without charge to Louisville, no <br />later than ninety (90) days after attachment of the facility. <br /> <br />10. Louisville will not perform engineering services for <br />Superior but shall be entitled to review and comment on superior's <br />plans for the sewage collection system and to inspect installations <br />thereunder at all times at Louisville's own expense. <br /> <br />11. (a) superior shall allow no discharge to the Louisville <br />sewage treatment system and Louisville shall have no obligation to <br />accept any discharge which does not meet quality standards <br />applicable within Louisville as adjusted from time to time. <br />Currently, Louisville has adopted and is enforcing an industrial <br /> <br />6 <br />
