<br />pretreatment ordinance to control the discharge of pollutants to <br />the City's collection and treatment system. Superior shall adopt <br />and enforce similar ordinances so that discharges to the Superior <br />system which are ultimately conveyed to the Louisville system shall <br />meet the quality standards set by Louisville. Superior's <br />ordinances shall be reviewed and approved by Federal and State <br />agencies, as necessary, and by Louisville. Superior's discharge <br />shall not exceed the maximum pollutant standard set by Louisville, <br />as described in Exhibit 4. It is further understood that <br />environmental regulations are regularly changed to meet identified <br />public needs. If Louisville adjusts its quality standards, <br />superior shall make similar adjustments to its quality standards as <br />identified in a sewage discharge ordinance, but Louisville may not <br />establish more stringent standards for Superior than for Louisville <br />unless required to comply with federal or state law. <br /> <br />(b) superior shall be responsible for the monitoring and <br />enforcement as set by federal and state regulations of its <br />industrial pretreatment program. <br /> <br />(c) Superior shall either diligently and in good faith <br />enforce Superior's ordinances adopted pursuant to this paragraph 11 <br />or take all action necessary to permit Louisville to enforce <br />effectively such ordinances and cooperate in such enforcement by <br />Louisville. Upon the failure of Superior to do so, Superior shall <br />indemnify and hold Louisville harmless for all fines or penalties, <br />including reasonable attorney fees and costs incurred by Louisville <br />related thereto, which are imposed upon Louisville as a result from <br />any substandard discharge of Superior and from any connection to or <br />use by Superior of the Louisville system. Any fines or penalties <br />collected as a result of Louisville's enforcement of the superior <br />ordinances shall be paid to Louisville. If Superior enforces the <br />ordinances, it may retain all fines and penalties less actual costs <br />incurred by Louisville related to the enforcement and not otherwise <br />paid to Louisville. Any costs or expenses sought to be recovered <br />for enforcement of the superior ordinances shall include costs or <br />expenses of Louisville to be paid to Louisville upon collection. <br /> <br />12. Louisville and Superior each agree that inflow and <br />infiltration into the Superior sewage collection system must be <br />limited in order to provide for economical treatment, and they each <br />agree that such inflow and infiltration shall be limited in <br />accordance with standards applicable within Louisville, as they may <br />be adjusted from time to time. <br /> <br />13. Superior shall be fully liable for all unreported <br />connections to the Superior sewer collection system contributing <br />flow to Louisville and shall pay all tap fees, treatment fees, and <br />charges thereon and shall disconnect such connections which do not <br />comply with this Agreement. <br /> <br />7 <br />
