pretreatment ordinance to control the discharge of pollutants to the City's collection and treatment system. Superior shall adopt and enforce similar ordinances so that discharges to the Superior system which are ultimately conveyed to the Louisville system shall meet the quality standards set by Louisville. Superior's ordinances shall be reviewed and approved by Federal and State agencies, as necessary, and by Louisville. Superior's discharge shall not exceed the maximum pollutant standard set by Louisville, as described in Exhibit 4. It is further understood that environmental regulations are regularly changed to meet identified public needs. If Louisville adjusts its quality standards, superior shall make similar adjustments to its quality standards as identified in a sewage discharge ordinance, but Louisville may not establish more stringent standards for Superior than for Louisville unless required to comply with federal or state law. (b) superior shall be responsible for the monitoring and enforcement as set by federal and state regulations of its industrial pretreatment program. (c) Superior shall either diligently and in good faith enforce Superior's ordinances adopted pursuant to this paragraph 11 or take all action necessary to permit Louisville to enforce effectively such ordinances and cooperate in such enforcement by Louisville. Upon the failure of Superior to do so, Superior shall indemnify and hold Louisville harmless for all fines or penalties, including reasonable attorney fees and costs incurred by Louisville related thereto, which are imposed upon Louisville as a result from any substandard discharge of Superior and from any connection to or use by Superior of the Louisville system. Any fines or penalties collected as a result of Louisville's enforcement of the superior ordinances shall be paid to Louisville. If Superior enforces the ordinances, it may retain all fines and penalties less actual costs incurred by Louisville related to the enforcement and not otherwise paid to Louisville. Any costs or expenses sought to be recovered for enforcement of the superior ordinances shall include costs or expenses of Louisville to be paid to Louisville upon collection. 12. Louisville and Superior each agree that inflow and infiltration into the Superior sewage collection system must be limited in order to provide for economical treatment, and they each agree that such inflow and infiltration shall be limited in accordance with standards applicable within Louisville, as they may be adjusted from time to time. 13. Superior shall be fully liable for all unreported connections to the Superior sewer collection system contributing flow to Louisville and shall pay all tap fees, treatment fees, and charges thereon and shall disconnect such connections which do not comply with this Agreement. 7
