WHEREAS, the City Council, after proper notice as required by law, has held a <br /> public hearing on this ordinance providing for the adoption of the Louisville Municipal <br /> Code amendments set forth herein; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF LOUISVILLE, COLORADO: <br /> Section 1. Section 13.12.030 of the Louisville Municipal Code is hereby <br /> amended to read as follows (words added are underlined; words deleted are stricken <br /> through): <br /> Sec. 13.12.030. Tap fee for residential units; fire sprinklers. <br /> A. If the applicant for a water service requests a tap and meter that are not the <br /> same size or a tap that is larger than is required by reference to the plumbing <br /> code adopted by the city and set forth in Title 15, the fee charged shall be the <br /> minimum fee for the size meter required, and any change in the meter size shall <br /> be subject to the provisions of subsection 13.12.040.A.2 of this chapter. <br /> B. - -- - . - - -- - - - - - e..--- - - - - -- - - - ' - • - <br /> the consumer's residential unit and for emergency service only, which requires a <br /> city and set forth in Title 15, as then in effect, and by reference to the table of <br /> chapter. The user shall be required to pay the full cost of installation of the <br /> service, including all pipe, valves and valve boxes. In the event an applicant <br /> installing an automatic fire-control system within a new residential dwelling as <br /> required by title 15 of this code is required to use a tap or service larger than <br /> three-fourths-inch, the additional tap fees otherwise payable for the larger tap or <br /> by the city manager in <br /> h table of fees established g <br /> service pursuant to the y y <br /> accordance with section 13.12.040 shall be waived if it is demonstrated by <br /> evidence satisfactory to the Public Works Director that the larger tap or service <br /> would not be required in the absence of the requirement to install an automatic <br /> fire-control system within a new residential dwelling. <br /> Section 2. Section 13.12.040 of the Louisville Municipal Code is hereby amended <br /> by the addition of a new subsection A.7 to read as follows: <br /> Sec. 13.12.040. Tap fees. <br /> 7. Tap fees shall not be charged for non-residential taps that are acquired, <br /> installed and utilized at all times solely for fire lines and automatic fire-control systems. <br /> In the event such a tap is ever utilized for any purpose or connected to any fixtures or <br /> facilities other than or in addition to fire lines and automatic fire-control systems, all tap <br /> fees for such tap shall be paid to the City in accordance with the table of fees <br /> established by the city manager in accordance with section 13.12.040 and then in <br /> effect. <br />
