Advi.ory opinions. <br /> <br />A. The municipal judge shall obtain, upon the adoption of this <br />chapter and shall thereafter maintain, the consent of one or <br />Ilore judge. of municipalities other than LoUisville, to <br />provide advisory opinions with respect to the applicability of <br />Sections 2. 80.030 through 2.80.050. The nalle. of such <br />advi.ory judge. shall be provided to the city council, the <br />city admini.trator, and the city attorney. The reasonable <br />expen... and fe.. of an advi.ory judge providing such an <br />opinion shall be paid by the city. <br /> <br />B. It any public officer or employee is uncertain as to the <br />applicability of Sections 2.80.030 through 2.80.050 to a <br />particular situation, or aa to the definition of terms used in <br />said sections, the officer or employ.e may apply in writing <br />for an opinion fro. an advIsory judge pursuant to this <br />section. The application shall state in detail the applicable <br />tacts and the section or sections of this chapter concerning <br />which the opinion is requested. <br /> <br />c. An opinion rendered by an advisory judge pursuant to this <br />section shall be binding upon the city, the city council, and <br />the city attorney, and in any subsequent actions concerning <br />the public officer or ..ploye. who SOU9ht the opinion and <br />acted on it in gOOd faith, unless material tacts were omitted <br />or mi..tated in the request for the advisory opinion. <br /> <br />O. An opinion rendered by an advisory judge pursuant to this <br />section ahall be disclosed to the public by public posting, <br />unle.. the advisory judge who issued the opinion determine. it <br />in the b..t interest of the city to delay such public posting, <br />in which ca.e the opinion shall be posted publicly as .oon as <br />the jUdge determine. that the best interest of the city will <br />no longer be harmed by public disclosure of the opinion. <br /> <br />2.80.080.
