Louisville City Council Meeting <br />December 16, 2003 <br />Page 8 of 18 <br />an economic plan. Planning Director Wood stated the Planning Department sent a <br />standard set of comments to STK, but did not request an economic study. Wood noted <br />there are a number of outstanding issues in the agreement. Ament stated that many of the <br />outstanding issues were left for Council direction. <br /> <br />Council member Brown asked Planning Director Wood to review what is permitted under <br />the PCZD zoning. Wood stated the PCZD zoning is intended for larger parcels. It <br />provides flexibility to incorporate, through a general development plan, identification of a <br />comprehensive or unified planning area, and circulation systems that serves 30 acres or <br />more. He stated it provides the flexibility of combining uses. He stated the general <br />development plan is the master plan document for a particular property. <br /> <br />Council member Brown asked how the general development plan correlates with the <br />PCZD zoning. City Attorney Light explained according to the zoning regulations the plan <br />must be submitted with an agreement. The agreement enforces and backs the planning <br />instrument, but also serves as a contractual bilateral commitment on the uses in each <br />district. <br /> <br />Council member Brown asked Planning Director Wood why the Centennial Valley <br />PCZD land use changed significantly from what was originally planned. Wood stated as <br />the market conditions changed, changes were made in the general development plan. <br /> <br />Council member Brown asked City Attorney Light if an amendment to the general <br />development could lead to litigation. City Attorney Light stated it would depend on how <br />broad the statement and the scope of the amendment proposed. <br /> <br />Council member Brown stated there have been implications made that on December 2, <br />2003, Council approved residential development on the STK site. He asked Planning <br />Director Wood if residential development has been approved on the STK site. Wood <br />responded no. <br /> <br />Council member Brown asked Finance Director Laus if the financial analysis correlated <br />with the build out of the development. Laus responded yes, and noted none on the <br />rebates or sales tax increments were included in the current financial analysis. <br /> <br />Council member Keany had several questions for City Attorney Light relative to vesting <br />rights; if the zoning were done individually by parcel, would there be a question of <br />vesting rights and if a parcel was zoned without vesting rights, could a future Council <br />change the zoning without the landowners' permission? Light responded yes. Keany <br />asked what method would give this Council and future Council's the most options. Light <br />stated it would depend on the general development plan. Planning Director Wood <br />added the rezoning ordinances carry the Weight of enforcement to address each zone <br />district on a large parcel. <br /> <br />8 <br /> <br /> <br />
