CHARLOTTE HOUSTON BOULDER CNTY CO RECO~__R <br /> <br />]- 1 <br /> <br />ORDINANCE NO. 1043 <br />Series 1991 <br /> <br />AN ORDINANCE CONCERNING THE CREATION OF A SPECIAL <br />IMPROVEMENT DISTRICT BY THE CITY OF BROOMFIELD, COLORADO; <br />AUTHORIZING THE INCLUSION OF CERTAIN PROPERTY LOCATED IN <br />THE CITY OF LOUISVILLE, COLORADO WITHIN SUCH DISTRICT; <br />APPROVING THE CONSTRUCTION OF CERTAIN STREET IMPROVEMENTS <br />WITHIN SUCH DISTRICT; AND PROVIDING FOR OTHER HATTERS <br />RELATED THERETO. <br /> <br />WHEREAS, the City of Louisville, Boulder County, Colorado (the <br />"City" or "Louisville") is a statutory city duly organized and <br />existing under the laws of the state of Colorado; and <br /> <br />}~ <br />/ <br /> <br />WHEREAS, the City of Broomfield, Adams, Boulder, Jefferson, <br />and Weld Counties, Colorado ("Broomfield"), intends to create a <br />special improvement district ("District") for the purpose of <br />financing the construction and acquisition of certain street <br />improvements to the 96th Street interchange (the "Project") and to <br />finance the Project through the levy of special assessments on the <br />property owners of property located within the District who <br />specially benefit from the Project; and <br /> <br />WHEREAS, Storage Technology Corporation (for itself and STC <br />Real Estate Corporation by reason of merger in 1987) ("Property <br />Owner") owns real property (the "Property") which will be specially <br />benefited by the Project; and <br /> <br />WHEREAS, the Property Owner, by letter dated May 31, 1991, has <br />requested that the City approve an ordinance consenting to the <br />creation of the District by Broomfield and consenting to the <br />inclusion of the Property in the District; and <br /> <br />WHEREAS, the Property is located within the City; and <br /> <br />WHEREAS, Section 31-25-503 (1), Colorado Revised Statutes, <br />allows the creation of a special improvement district by a <br />municipality which may include any property located in another <br />municipality if the municipality within which such property is <br />located consents by ordinance to such District and to the <br />construction or acquisition of the improvements therein; and <br /> <br />1 <br />
