<br />~01069974 10/19/90 11 :23 AM REAL ESTATE RECORDS <br />F1648 CHARLOTTE HOUSTON BOULDER CNTY CO RECORDER <br /> <br />ORDINANCE NO. 1031 <br />(AMENDED) <br /> <br />AN ORDINANCE VACATING A PORTION OF AN ALLEY LOCATED IN CORRIGAN <br />ADDITION <br /> <br />WHEREAS, a certain property ownl=r has requested that a portion of <br />a right-of-way adjacent to their property be vacated to them; <br />and, <br /> <br />WHEREAS, the right of way is located on the perimeter of the <br />subdivision within which it was dedicated; and <br /> <br />WHEREAS, the City desires to maintain utility and pedestrian <br />easements in the right of way. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />LOUISVILLE, COLORADO: <br /> <br />.Q~.Q.ti9n 1._! That the portion of the alley described in Exhibit "A" <br />attached hereto be and the same hereby is vacated, subject to the <br />easements and rights-of-way described in Section 2 of this <br />Ordinance; and the title thereto is vested in the owners of the <br />property adjacent to such right--of-way, as provided by law. <br /> <br />.Q~ct_i9n 1-,- The Ci ty hereby reserves from the property vacated <br />pursuant to Section 1 of this Ordinance rights-of-way and ease- <br />ments for the use and maintenance of sewer, gas, water and simi- <br />lar pipelines and appurtenances and electric, telephone, and <br />similar lines and appurtenances, and further reserves from the <br />vacated property rights-of-way and easements for pedestrian <br />access to a width of 5' along the entire west boundary of the <br />area to be vacated as described in Exhibit A. <br /> <br />INTRODUCED, READ AND ORDERED PUBLISHED this 21st day of August, <br />1990. <br /> <br />PASSED AND ADOPTED ON <br /> <br />ordered ~ubl~s.hed this <br />."
