Sec. 2.76.010. Adoption of regulations. <br /> A. The city manager council shall adopt rules and regulations not inconsistent with the <br /> provisions of this chapter governing cemeteries within the city. Sections 2.76.100 through <br /> 2.76.200 shall apply to all cemeteries within the city. <br /> B. Such rules and regulations shall be on file and available for public examination in the office <br /> of the city clerk. <br /> C. Failure to comply with any rule or regulation promulgated under this chapter shall be <br /> deemed a violation of this Code. <br /> Sec.2.76.020. Administration. <br /> The administration and supervision of the city cemetery shall be by the direction of the <br /> .. . . ... . . . -. •: • city manager, who shall employ such other persons as may be <br /> necessary for the care and maintenance of the city cemetery. The city manager may delegate to <br /> the manager's designee(s) any powers or duties conferred upon or assigned to the city manager <br /> under this chapter, and wherever reference in this chapter is made to the city manager, such term <br /> means and includes the city manager and the manager's designee(s). <br /> Sec. 2.76.030. Duties of city manager. <br /> It shall be the duty of the director of parks and recreation city manager, or persons <br /> designated appointed by him, to ensure that the rules and regulations governing the cemetery are <br /> followed and adhered to. <br /> Sec. 2.76.040. Map and records; burial permits. <br /> A. The director of parks and recreation city manager shall require application for all burial <br /> permits to be made before the funeral. <br /> B. It shall be the duty of the .' . . ... .. : - -. : - city manager to keep a map of the <br /> records of the cemetery, and to issue required burial permits. <br /> C. No permits shall be issued without the name and address of the let owner; of the right to <br /> interment for and the lot and block number for which application is made. <br /> D. All burial permits shall be issued by the director of parks and recreation city manager and <br /> shall give the lot and block number for burial. <br /> Sec. 2.76.050. Application for burial space to become contract when executed. <br /> A. Applications for the purchase of burial spaces shall contain a description of the space, the <br /> purchase price and the method of payment. When executed by the purchaser and the city, the <br /> application shall become a binding contract of purchase and sale. <br /> B. Upon payment of the full purchase price to the city, a certificate of purchase by the city, <br /> executed signed by the mayor city manager or the manager's designee and conveying the <br /> Ordinance No. 1666, Series 2014 <br /> Page 2 of 7 <br />
