right of interment for the designated burial space free and clear of all encumbrance&, shall be <br /> executed and delivered to purchaser. <br /> C. All certificates of purchase shall grant to the lot owner or owners the right to use such lot for <br /> burial purposes only, subject to this chapter and the rules and regulations adopted by the city <br /> manager council. <br /> Sec. 2.76.060. Price of spaces. <br /> The sale price of burial gee spaces, shall be established by the director of parks and <br /> recreation city manager. Fifty percent of the proceeds from the sale of lots shall be placed in the <br /> city's "cemetery perpetual care fund," and 50 percent shall be placed in the city's "cemetery <br /> fund." <br /> Sec. 2.76.070. Transfer of propegy right. <br /> No transfer, assignment or conveyance of any property right burial space or interest in the <br /> city cemetery shall be valid without the consent in writing of the city. The city shall not consent <br /> to the transfer, assignment or conveyance of any property right burial space or interest in the city <br /> cemetery upon which there is any indebtedness due the city. Any deed, certificate of purchase or <br /> other instrument issued by the city for burial space in the city cemetery grants interment rights <br /> only and no title to real property is thereby conveyed. <br /> Sec. 2.76.080. Selling burial spaces lots for resale. <br /> No lot or space shall be sold to or purchased by a funeral director or other persons for <br /> purposes of resale or speculation. <br /> Sec.2.76.100. Interments. <br /> Application and permission for interment, interment charges and payment, and permissible <br /> use of burial space shall be governed by the rules and regulations of the cemetery. It shall be <br /> conclusively presumed, unless written notification to the contrary is filed with the director of <br /> city manager, that any burial space purchased in the city cemetery is being <br /> acquired for family use; and the city shall have the right upon the receipt of written permission <br /> from the recorded owner of such let burial space to allow interment in such space of any member <br /> of the family of the owners. <br /> Sec. 2.76.110.
