He suggested speed humps be discussed at the next
Work Session.

Bill Simmons, City Administrator, commented that he would ask the Police Dept. to patrol the area.

COUNCIL INFORMATIONAL COMMENTS ON PERTINENT ITEMS
NOT ON THE AGENDA

NONE

REGULAR BUSINESS

RESOLUTION NO. 37, SERIES 1996 - INTERGOVERNMENTAL AGREEMENT -
LAFA YETTEILOUISVILLE BUFFER COMPREHENSIVE DEVELOPMENT PLAN -
PUBLIC HEARING (PUBL. LSVL. TIMES 6/1 & 6/8/96)

Bill Simmons, City Administrator, stated that this resolution proposes that Council adopt an
intergovernmental agreement with the City of Lafayette and Boulder County for the joint adoption
of the Comprehensive Development Plan for the purpose of planning land between Lafayette and
Louisville. This agreement would replace an agreement that was forged in 1985 and is set to expire
in the year 2000. The term of the new agreement is for 20 years.

Davidson opened the public hearing and called for public comments.

Larry Johnson, Attorney, 1675 Broadway, Suite 2100, Denver, Colorado 80202, representing
Boulder County Land Venture, owners of the parcel that is designated as Parcel No.1 on the buffer
plan, stated that on the eastern edge of the parcel there is a cross-hatched section that is designated
as a buffer area. He explained that the property is the subject of an annexation and zoning agreement
dated June 1976. One of the provisions of the agreement was for the providing of open space. His
client's concern was that they believed that their open space requirements had already been met by
dedication of open space in the larger parcel that was subject to this agreement. The cross-hatched
area, ifit is 150' wide, encompasses about nine acres of the parcel of 153 acres. Their concern was
that the signing of this agreement commits the City to a course of action that varies from the
annexation and zoning agreement and puts into effect a nine acre cloud hanging over their property

2
