<br />located on the southeast corner of the east parcel along 96th Street. The City suggested that the <br />County assume management and maintenance responsibilities for that house. <br /> <br />Susan Griffiths, City Attorney, stated that there were a number of technical corrections that still <br />needed to be made to the final Purchase Agreement and the Conservation Easement. All of those had <br />been discussed with the County Attorney and they were in agreement with virtually all of those. She <br />pointed out that the City would be getting a Special Warranty Deed rather than a General Warranty <br />Deed for both the property and the water rights. The Conservation Easement is based generally on <br />the Conservation Easement that the City and Boulder County entered into respect to the Lastoka <br />property. <br /> <br />Davidson called for Council comments, questions, or motions. <br /> <br />Sisk recognized the efforts of City staff, Commissioners Mendez, Stewart, and Danish for their help <br />and assistance in allowing Louisville to purchase this property. <br /> <br />Mayer commended the Mayor for his negotiations in the successful completion of this purchase. <br /> <br />Sisk moved that Council adopt Resolution No. 38, Series 1996, approving a property purchase <br />agreement between the City of Louisville and Boulder County, et al. Seconded by Howard. Roll call <br />was taken. Motion passed by a 7 - 0 vote. <br /> <br />RESOLUTION NO. 39, SERIES 1996 - INTERGOVERNMENTAL AGREEMENT FOR K- <br />12 CAMPUS IN THE CITY OF LOUISVILLE, COLORADO <br /> <br />Bill Simmons, City Administrator, stated that this Intergovernmental Agreement would be between <br />the City of Louisville and the Boulder Valley School District for the new K-12 school campus off of <br />88th Street. Through the IGA the School District agreed to petition to the City of Louisville for <br />annexation, make certain dedications to facilitate the construction of public improvements, and the <br />City agreed to reconstruct 88th Street from Dillon Road to Health Park Drive, including a pedestrian <br />underpass under 88th Street, and subject to the City's legislative discretion the school campus parcel <br />is to be zoned PCZD-R for the main body of the land and PCZD-C for the area totaling 5.5 acres <br />along 88th Street. <br /> <br />Davidson pointed out two changes that were discussed at the Work Session and with School Board <br />member Don Shonkwiler, who had no objection: Page 2, paragraph No.2, six lines down "....to be <br />zoned PCZD-C." rather than ..."PCZD-R."; Page 3, paragraph No.9, add paragraph "g." after <br />paragraph "f." stating "South 88th Street will be constructed as a two-lane roadway with median, <br />with appropriate additional acceleration/deceleration and left-turn lanes, with no future plans for <br />expansion.
