<br />RECESS <br /> <br />Davidson called for a five minute recess. <br /> <br />Davidson called the meeting back to order. <br /> <br />Don Orr, 6500 Arapahoe Boulevard, Boulder, Colorado, stated that on June 13 the School Board <br />considered this agreement as a discussion item. Subsequent to that time minor modifications had <br />been suggested by the City's Attorney and their legal staff, which had been incorporated into Council's <br />draft in handwritten notes. The School Board is scheduled to adopt this as a consent item at their <br />June 27 meeting. He added that any substantive changes to the agreement proposed and approved <br />tonight by Council would necessitate the item being withdrawn from the June 27 meeting and the next <br />opportunity to review this would be in August. Consequently, the District would not request <br />processing of the annexation, subdivision, and zoning request until such time as the Board takes <br />action on the Intergovernmental Agreement. Traffic flow, traffic volumes, and safety to the children <br />would be paramount in dictating the width of the roadway. <br /> <br />Howard explained that the reason the road is limited to two lanes is because there is a bridge that is <br />limited to two lanes. <br /> <br />Orr pointed out that there were provisions in the Intergovernmental Agreement soliciting the City's <br />cooperation in working with the County and State in making the necessary improvements to the <br />existing crossing at 88th Street. He felt that to assume the bridge would remain as is was risky. <br /> <br />Davidson stated that the School District requested that the commercial property the School District <br />is going to resell would not participate in any further road improvements. Commercial property does <br />participate in future road improvements, so if the School District believed that it will someday be a <br />four lane road, that would have to be removed. He explained that this was looked at as a win/win <br />situation - the School District gets what they want, which is no further encumbrances on the <br />commercial property and the City builds a two lane, plus median, and various acceleration and <br />deceleration lanes. <br /> <br />Sisk had talked to Orr during the recess about some language that might be acceptable. <br /> <br />Orr suggested language that the School District understands that the Phase I construction of South <br />88th Street would be a two lane roadway with median, shoulder, turn lanes, and all associated <br />improvements to a city arterial roadway. He stated that the School District expects that the City of <br />Louisville would from time to time make improvements to South 88th Street as safety requirements <br />and traffic patterns dictate. <br /> <br />Davidson found that completely unacceptable as it implied that the road would be further developed <br />by the City.
