City Council <br />Meeting Minutes <br />May 20, 2014 <br />Page 17 of 20 <br />Attorney Light noted there was always a limited use of purchase of a burial space and <br />subject to forfeiture in compliance to the cemetery rules and regulations adopted by the <br />municipality. One of the reasons for the change was to not have so many conveyances <br />at the Clerk and Recorder's office. <br />RESOLUTION No. 30, SERIES 2014 <br />MOTION: Council member Lipton moved to approve Resolution No. 30, Series 2014, <br />seconded by Mayor Muckle. All were in favor. <br />ORDINANCE No. 1666, SERIES 2014 <br />MOTION: Mayor Muckle moved to approve Ordinance No. 1666, Series 2014 on first <br />reading, ordered it published and set a public hearing for June 3, 2014, seconded by <br />Council member Lipton. All were in favor <br />ORDINANCE No. 1663, SERIES 2014 — AN ORDINANCE AMENDING SECTON <br />13.24.030 OF THE LOUISVILLE MUNICIPAL CODE REGARDING SEWER TAP <br />FEES — 2nd Reading — Public Hearing <br />Mayor Muckle requested a City Attorney introduction. <br />City Attorney Light introduced Ordinance No.1663, Series 2014. <br />Mayor Muckle opened the public hearing and requested a staff presentation. <br />Public Works Director Kowar reported as a result of the Utility Rate Study an inequity <br />was identified in the way the City charges nonresidential wastewater system <br />development fees. The existing wastewater tap fees are set at half of the water tap fee, <br />which has no relation to actual costs incurred by the utility for providing sewer service. <br />In order to be in compliance with industry standards, the RFC recommended fees were <br />adopted in Resolution No. 71, Series 2013, on December 17, 2013. However, after the <br />Resolution was adopted, staff discovered another clause in the City Code conflicts with <br />implementation of the updated sewer tap fees; specifically the clause specifies sewer <br />tap fees for unspecified uses shall be one half of the total water tap fee paid. The <br />proposed change removes the conflict and allows City Council to set sewer tap fees by <br />resolution. The proposed Ordinance change will result in adoption of lower sewer tap <br />fees, which will result in lower wastewater fund revenues. <br />Sewer Tap Fees — Section 13.24.030 <br />A. The sewer tap fee for single - family dwellings, including mobile homes, and each <br />dwelling unit in a duplex shall be as set forth in a city council resolution <br />establishing such fees. <br />
