The BOA may grant a variance only if it makes findings that all of the criteria, <br />as established under Section 17.48.110.6.1-6, have been satisfied, insofar as applicable: <br />The applicant has provided a written analysis of the variance criteria, which has been <br />included in the BOA packet materials. Following is a staff review and analysis of the <br />variance criteria. <br />1. That there are unique physical circumstances or conditions such as irregularity, <br />narrowness or shallowness of lot. or exceptional topographical or other physical <br />conditions peculiar to the affected property. <br />Lot size and lot area requests: <br />The subject property lies within the Capitol Hill Subdivision in the Old Town area. Lots in <br />this subdivision were platted at a dimension of 25 feet by 125 feet, consistent with the <br />majority of lots in Old Town Louisville. While some lots were developed with single-family <br />homes on a single, 25-foot lot, the majority of lots in Old Town were built on a combination <br />two originally platted lots. Only a few properties in Old Town actually contain more than <br />two originally platted lots. In this case, the subject property contains five platted 25-foot <br />lots and a lot area of 14,436 SF. Staff finds the lot size to be exceptionally wide and <br />unique when compared to adjacent lots and Old Town standards. Staff finds that this <br />criterion has been met. <br />Rear yard setback request: <br />In contrast, there are no unique circumstances or conditions peculiar to this property which <br />would warrant a variance to the rear yard setback request. Staff finds this criterion has <br />not been met. <br />2. That the unusual circumstances or conditions do not exist throughout the <br />neighborhood or district in which the property is located. <br />Lot size and lot area requests: <br />The 125-foot lot dimension is more than twice as wide than the typical developed lot <br />pattern in Old Town. As a whole, the lots in Old Town Overlay are predominantly 50' X <br />125', which consists of the combination of two 25' X 125' lots. In the immediate vicinity, <br />there are a few lots that are three lots combined, but none as large as this one. In looking <br />at the district as a whole, it is unique to have five 25' X 125' lots combined to create one <br />lot. Staff finds this criterion has been met. <br />Rear yard setback request: <br />There is no example of a principal structure rear setback of 10-feet in the neighborhood <br />and few examples throughout Old Town, staff does not believe this criterion has been met. <br />3. That because of such physical circumstances or conditions, the property cannot <br />reasonably be developed in conformity with the provisions of Title 17 of the <br />Louisville Municipal Code. <br />Lot size and lot area requests: <br />4 <br />
