Residential Overlay. The Old Town Overlay was adopted in 1996 and was intended to <br />preserve the residential character and scale of the Old Town area, while at the same time <br />providing some greater zoning flexibility to existing non -conforming lots and structures. <br />The ordinance relaxed some of the lot coverage and setback requirements for smaller lots. <br />The Old Town Overlay did not amend the minimum lot area and width requirements in the <br />RL district. <br />PROPOSAL: <br />The property owners are requesting a variance to split the existing 14,436 SF, 125-foot <br />wide lot into two lots: <br />• Lot 1 will be 7,442 SF and will be 65 feet wide; <br />• Lot 2 will measure 6,870 SF and will be 60 feet wide; <br />This request requires variances from the minimum lot size and minimum lot width <br />requirements documented in the RL zone district. The RL zone district requires a <br />minimum lot width of 70' and lot area of 7,000 SF. However, for properties containing a <br />corner lot, the minimum lot area for a corner lot is 8,000 SF. Therefore the applicant <br />needs lot width and lot area variance for both lots. <br />Additionally, the applicant is requesting a rear -yard setback variance for a primary <br />structure on the proposed Lot 1. The Old Town Overlay requires a 25 foot rear yard <br />setback for primary structures. The existing garage (accessory structure) retains a rear <br />yard setback of approximately 10'. The owner is proposing to attach this structure to a <br />newly constructed home (principal use). If a garage is attached to a principal structure, the <br />combined structure is required a rear yard setback of 25-feet. As a result, the applicant is <br />requesting a variance from the required 25-foot principal structure setback. <br />If the variance requests were to be approved by the Board, a minor subdivision replat <br />application would need to be submitted and approved through the Planning Commission <br />and City Council public hearing processes. Upon approval of a minor subdivision plat, the <br />property owner(s) would be allowed to apply for building permits for the proposed new <br />construction. Building permits would be reviewed for compliance with all requirements of <br />the Old Town Overlay. <br />It should be noted that the orientation of the lots will be to the east, facing Lincoln Avenue <br />and is consistent with the current configuration of the neighborhood. <br />If the property were to remain as a 14,436 SF property, the Old Town Overlay would <br />permit the construction of a building to cover approximately 4,330 SF and a total floor area <br />of 5,052 SF. A structure of this size would not be in character with other structures in the <br />Old Town Overlay District. <br />REVIEW CRITERIA: <br />The BOA has authority to hear and decide, grant or deny this application for a variance <br />from Section 17.12.040 of the LMC by the powers granted the BOA in Section 17.48.110 <br />3 <br />
