RESOLUTION NO. 33 <br />SERIES 2014 <br />A RESOLUTION APPROVING A SPECIAL REVIEW USE (SRU) FINAL PLANNED <br />UNIT DEVELOPMENT (PUD), AND RE -PLAT FOR PHASE 1 AND PHASE 1A OF A <br />14.13 ACRE REDEVELOPMENT WITHIN THE CORE PROJECT AREA OF THE <br />HIGHWAY 42 REVITALIZATION DISTRICT — DELO PROJECT PHASE 1, <br />SOUTHWEST CORNER OF GRIFFITH STREET AND CANNON STREET <br />WHEREAS, there has been submitted to the Louisville City Council an <br />application for approval of an Special Review Use (SRU), Final Planned Unit <br />Development (PUD), and re -plat for Phase 1 and Phase 1A of a 14.13 acre <br />redevelopment within the core project area of the HWY 42 Revitalization District. The <br />project will be developed to include a diversity of housing products, civic spaces, urban <br />plazas, streetscapes and commercial opportunities, formally known as DELO; and <br />WHEREAS, the subject property is in the Highway 42 Revitalization Area; and <br />WHEREAS, Section 17.14.020 of the LMC requires any property in the Highway <br />42 Revitalization Area be rezoned in conformance with the Land Use Plan incorporated <br />as Exhibit A in LMC Chapter 17.14 before being developed or redeveloped; and <br />WHEREAS, the ground floor residential along Cannon Street requires a special <br />review use permit and staff has found the request with conditions meets the five criteria <br />established in Section 17.40.100 in the LMC; and <br />WHEREAS, the City Staff has reviewed the information submitted and found it to <br />comply with the LMC Sec. 16.12.030, Sec. 17.14.090, Sec. 17.28.170; and Sec. <br />17.40.100; and <br />WHEREAS, after a duly noticed public hearing on May 8, 2014, where evidence <br />and testimony were entered into the record, including the findings in the Louisville <br />Planning Commission Staff Report dated May 8, 2014, the City of Louisville Planning <br />Commission approved a resolution to forward a recommendation of approval, with <br />conditions to the City Council; and, <br />WHEREAS, City Council has reviewed the application, including the <br />recommendation of the Planning Commission and finds that said final PUD <br />development plan should be approved, subject to four conditions listed below. <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Louisville, Colorado, based on the evidence and testimony presented at the hearings, <br />does hereby approval of a Special Review Use (SRU) Final Planned Unit Development <br />(PUD), and re -plat for Phase 1 and Phase 1A of a 14.13 acre redevelopment within the <br />core project area of the HWY 42 Revitalization District.
