1. Should a regional offsite detention basin be created to detain the drainage of the Highway 42 development (including Phase 1 and Phase 1A), the project must include a community garden as shown in the original plans. 2. If an off -site regional detention pond is not approved, the detention basin and public gathering space located in Tract G, Tract H and within the E. Lafayette Street right of way shall be constructed with stairs stepping down from Cannon Street through the proposed retaining walls to make this space more publically interactive; further the stairs should be a minimum width of 50 feet along Canon Street, or an alternative design approved by City staff that is open and accessible. 3. The applicant should submit a public art master plan with Phase 2, showing how public art/signage will be integrated throughout the development. The public art/signage should reflect the previous historic use of this area for the Louisville Rod and Gun Club. 4. The applicant shall work with City staff to identify ways to minimize up -light issues while maintaining the historic nature of the lighting fixtures. 5. The applicant shall process a right -of -way vacation application for vacation of the originally platted North Front Street right -of -way. If the plat will be recorded prior to final effectiveness'of the vacation ordinance, revise the plat sheets to designate the original platted right -of -way as "to be vacated by separate ordinance." If the vacation is not effected, a maintenance agreement shall be required to provide for private maintenance of the right -of -way. 6. The final architectural elevations shall be revised to include additional height, roofline, facade and other architectural elements variations to further the intent of the MUDDSG that the development include variety in mass, scale and materials, avoid a "barrack- type" or repetitive appearance, and create the appearance of development that occurred over a period of time. The focus of the revisions should be to further mitigate massing /scale impact on the Little Italy neighborhood. The final, revised elevations shall be submitted to and subject to administrative review and approval by the Director of Planning and City Manager.
