Reposted and remailed on <br />February 4, 2013. <br />Conflict of Interest: <br />None heard. <br />Staff Report of Facts and Issues: <br />Russ reviewed the request with the following discussion points: <br />. The applicant is requesting a final PUD amendment to allow the removal of a <br />condition that the house located on the east side of Lot 3 (555 County Road) <br />be demolished. <br />• The request is also seeking permission to allow an increase in density from 15 <br />units to 16 units, by allowing a 2nd unit on Lot 3. <br />• Resolution 25, Series 2009 approved the original plat and PUD for 15 units <br />and the demolition requirement for the easterly home of Lot 3 which would <br />keep the development at 15 units. <br />• The request requires a waiver to the PUD and underlying zoning (Residential <br />Medium Density — RM). <br />• Section 17.28.110 details the criteria fora waiver approval. <br />1. City council finds that the development plan contains areas allocated for <br />usable open space in common park area in excess of public use <br />dedication requirements. <br />a. Staff finds this criterion has not been met. <br />2. The waiver is warranted by the design and amenities incorporated in the <br />development plan, and the needs of residents for usable or functional <br />open space and buffer areas can be met. <br />a. Staff finds this criterion has been met. <br />Russ reviewed the revised Resolution No. 3, Series 2013 and requested approval <br />with the following condition: <br />1) A public land dedication fee shall be paid upon subdivision or creation of <br />separate ownership for any portion of Lot 3 accordance with Section <br />16.16.060 of the LMC. <br />Russ requested a motion to enter into public record the revised resolution as well as <br />the emails received supporting the request. <br />Lipton moved and Pritchard seconded a motion to enter those items into public <br />record. Motion passed by voice vote. <br />
