Planning Commission <br />Meeting Minutes <br />February 28, 2013 <br />Page 3 of 8 <br />Commission Questions of Staff: <br />Moline asked if the past record gives any rationale for the demo. <br />Russ stated it is a density issue. <br />Lipton stated the underlying zoning was also the reason for the 15 units, so the <br />applicant is requesting for an exception. <br />Russ agreed with Lipton's comments. <br />Russell inquired if the fee -in -lieu is captured by the LMC. <br />Russ confirmed it. <br />Russell asked if there are any access concerns. <br />Russ stated no. <br />Russell asked if the floodplain is impacted. <br />Russ stated no. <br />Applicant Presentation: <br />Mundelein clarified his plan to demo the current house and then build a new two <br />story home. He stated they would like to keep the 2nd unit as a rental. <br />Commission Questions of Applicant: <br />None heard. <br />Public Comment: <br />None heard. <br />Commission Questions of Staff and the Applicant <br />Brauneis asked the other board members if they had background of why the 15 units <br />were chosen. <br />Russ stated more than 15 had been requested by the applicant but staff based the <br />15 on the square footage of the site. <br />Russell asked if a new house is built and the existing alley house is rented, how <br />would this change the character of the site. <br />Russ stated they would have to follow Old Town Overlay Zone District requirements. <br />Moline inquired about the accessory dwelling and its use as a rental. <br />Russ stated the current zoning allows a 2nd unit, because of the lot size, therefore a <br />second unit would be allowed. <br />Lipton asked for a clarification as to how the request came forward. <br />Russ explained that the applicant has the right to ask, staff has an obligation to <br />process with a public hearing before Planning Commission and then City Council. <br />Mundelein stated he came forward because of his interpretation of how many units <br />he can have. He stated he plans to build a front house and wants to keep the back <br />unit as a legal dwelling unit to rent out. <br />Closed Public Hearing — Planning Commission Discussion: <br />Moline stated he tends to agree with staff but would like to hear from the other <br />Commissioners first. <br />
