In speaking with the City Attorney, this is allowable, <br />defendable,and fair. The City has the right to do that. No other entity has the right to do <br />that. <br />Tengler says would food trucks be allowed on three sides of the park? <br />Russ says if it is in the Art Center, it is within the ROW but only Spruce. If you used <br />Memory Square Park, it would be Walnut, Jefferson, and Spruce. <br />Russell says this is a community resource. I am fine with the condition but would like to <br />see language at a future meeting. There may be urgency advancing this. <br />Tengler asks if 150’ is okay or with 300’. <br />Russ says the 150’ difference would allow food trucks on North Main and East Pine. <br />On McCaslin, it is almost the same exact restriction because they can’t operate on <br />McCaslin. It has no net difference in Centennial Valley; it does present differences in <br />Downtown. <br />Russell says it seems reasonable to go with minimal regulation that accomplishes this <br />goal. <br />Tengler says thereseems to bea consensustoward scratching pre-packaged, <br />McConnell’s position notwithstanding, and the 150’ buffer is acceptable. I’d like to get to <br />some resolution on the Art Center but it may not be possible tonight. We may have a 3- <br />3 split in terms of that. <br />O’Connell says on the Art Centerissue,it’s just a matter of language. If she made a <br />motion to explore that as an exception and weigh the pros and cons,she would leave it <br />up to the City Attorney with the recommendation that we would like to see some sort of <br />carve-out for the Art Centerif it is feasible anddone in the matter that is in the best <br />interest of the City overall. <br />Brauneis says ifthere is a condition that Staff work with the City Attorney to draft <br />language to allow events held within the Art Center to host food trucks within the <br />adjacent ROW, we wouldcomfortable with something like that. As far as Staff’swork,I <br />think there is a ticking clock with summer approaching and trying to get this to Council <br />sooner. <br />Russ says it was originally slated for last summer and then they wanted the sales tax <br />evaluation of Community Park. There is a desire as summer approaches. <br />Brauneis says from Staff perspective, since we are an advisory board to City Council, <br />we have at least instructed Staff to come up with language that they can see <br />immediately,and thengo with whatever direction they feel is appropriate for the City. <br />We have provided them with that as one of their options. <br /> <br />
