This complies with that requirement except the relocated 50-year house which is <br />too short. <br />TRAFFIC In the preliminary, overall development was analyzed against the traffic <br />volume in the Highway 42 corridor. There was no change in level of service with the <br />development that is proposed. From traffic operations perspective, this is consistent <br />with the Highway 42 Plan recently completed. <br />ACCESS Phase 1/1A will be accessed off of Griffith Street. Future phases will come <br />south from the Cannon extension. As Phase 2 comes on line consistent with the <br />Highway 42 Plan and Redevelopment Plan of the district, Cannon Street will extend <br />south to South Street. Short Street will be improved in Phase 2 as well as a traffic <br />signal. The City has funding from the CDOT for a traffic signal. The timing of that <br />signal becoming operational depends on getting the infrastructure in and warrants. The <br />DELO Phase 2 development will need to come on line to warrant the actual activation of <br />the signal, but there is funding for the infrastructure of the signal. <br />SRU In the MUDDSG, in the mixed used residential district of the mixed use area, <br />there is a ground floor retail requirement. In the preliminary PUD which was reviewed, it <br />was waived because of practicality. The interior blocks and low traffic volumes showed <br />the economical viability of ground floor retail in this portion of the redevelopment district <br />did not make fiscal sense. The Louisville Revitalization Commission has studied it and <br />they worked with City Council to change the requirement to a SRU. Staff believes the <br />applicant has met all design requirements that were listed in the preliminary PUD. <br />REQUEST FOR WAIVERS In Section 16.16 of the LMC, subdivision waivers specific <br />to roadway design, the applicant is asking for narrower street on Cannon going from a <br />cross section to a cross section on Cannon. The cross section is operating <br />currently in Louisville at Elm Street which is in dimension as parking on both sides. <br />Public Works has reviewed the street dimension as has the Fire Protection District and <br />both are comfortable with the dimensions proposed for Cannon. <br />In regard to the waivers identified for the relocation of the 50-year old house, Chapter <br />17.14 allows for waivers. It allows for a case by case basis where the City may approve <br />alternative street design that varies from adopted standards. <br /> <br />Staff Recommendations: <br />Staff recommends approval of the requested SRU, final Plat, and final PUD for the <br />development called Downtown East Louisville. The waivers are appropriate under LMC <br />17.14 as well as 17.28 in the Planned Unit Development given the location of <br />surrounding land uses. Staff also determines that the applicant has met the conditions <br />required for the preliminary approval. <br />Staff recommends approval with three conditions: <br />1. Should a regional offsite detention basin be created to detain the drainage of the <br />Highway 42 development (including Phase 1 and 1A), staff requires the applicant <br />reinstate the original plans for the community garden (if Comcast consents). <br />2. In the meantime, the detention basin and public gathering space located in Tract <br />G, Tract H and within the E. Lafayette Street right-of-way, be designed to provide <br />stairs, stepping down from Cannon Street through the proposed retaining walls, <br />to make this space more publically interactive.
