City Council <br />Meeting Minutes <br />July 15, 2014 <br />Page 13 of 21 <br />proponent of government intervention in private sector activities, but was trying to keep <br />an open mind. He agreed a two -step process. <br />Mayor Muckle stated since the Sam's Club closed, there has been significant efforts <br />made by the private sector and the City to find a new use for the space. He noted the <br />new owner is local and felt the Council should be more involved at some level. <br />MOTION: Mayor Muckle moved to direct staff to bring forward for Council <br />consideration, a resolution recommending a finding of blight, but not an urban renewal <br />plan, seconded by Council member Lipton. <br />City Attorney Light explained under the Urban Renewal Law, only the City Council can <br />find blight. The direction to staff is to prepare a draft resolution making a determination <br />of blight for Council consideration. Council may consider, deny or adopt the resolution. <br />He asked if the City Council wanted further input from the Urban Renewal counsel on <br />the various procedures, costs, or timelines and whether staff should spend further <br />resources to gather the additional documentation. <br />Council member Loo requested more Council discussion on the various aspects and <br />information on the risks involved. <br />Council member Stolzmann suggested an alternative motion, to direct staff to provide <br />more information and legal counsel for further discussion at a future study session. <br />Council member Lipton voiced concern over discussing this matter in a study session. <br />He felt if more discussion is needed, it should be in a televised public meeting. <br />Mayor Muckle explained the motion directed staff to bring forward a resolution <br />determining blight, but no additional information on urban renewal plans. <br />VOTE: The motion passed by a vote of 4 -3. Mayor Pro Tem Dalton, Council members <br />Stolzmann and Moss voted no. <br />ORDINANCE No. 1669, SERIES 2014 — AN ORDINANCE AMENDING CHAPTERS <br />8.52 AND 8.56 OF THE LOUISVILLE MUNICIPAL CODE TO EXPAND THE CITY'S <br />SMOKING RESTRICTIONS TO INCLUDE MARIJUANA AND ELECTRONIC <br />SMOKING DEVICES — 2 "d Reading — Public Hearing <br />Mayor Muckle requested a City Attorney introduction. <br />City Attorney Light introduced Ordinance No. 1669, Series 2014. He pointed out there <br />are two versions of the ordinance, each having second reading amendments. <br />Mayor Muckle opened the public hearing and requested a staff presentation. <br />
