<br />under grounding would be the preferable way to go, if there is an equitable and appropriate way <br />to do that. Mr. Leh is interested in hearing how the cost will be allocated. <br /> <br />Commissioner Lipton thanked the Public Service Company representatives for the work they have <br />done. This is an issue of public planning that may have been ignored over time and it is only when <br />Public Service wants to expand the service, expand the poles and provide additional capacity does <br />it become an issue to the point of where it comes to the Planning Commission and City Council. <br />Mr. Lipton feels that the community needs to honor its obligations to Public Service and its <br />property rights that it has established. On the other hand the community does not need to go <br />further than that and Public Service will have to find other ways to provide the service where to <br />find ways of maintaining the service where it is through means that are now acceptable to the <br />current community standard. If the city wants to make an improvement to either relocate or bury <br />the lines that are either established today or through a high level of service that Public Service is <br />proposing, the community will have to contribute to that financially. Mr. Lipton does not blame <br />Public Service, he feels that it is the community doing what it has done in the past very well, but <br />ignoring a situation that probably not have been ignored if planned for in the future. <br /> <br />Mr. Lipton has formed his opinion already and right now given the standard of the community and <br />the community expectations that the current power lines don’t look very good, any kind of <br />upgrade or extension of them is not going to look any better, it will probably look worse. He has <br />prepared a motion to deny the request. He would like to act on the motion tonight. <br /> <br />Mr. Lipton read the motion he had prepared. “This is a motion to deny the Special Review Use <br />for Public Service Company of Colorado. <br /> <br />Whereas the Louisville Planning Commission finds that the requested Special Review Use will be <br />contrary to the general welfare in economic prosperity of the immediate neighborhoods and <br /> <br />Whereas that the proposed use and development will not lend economic stability compatible with <br />the character of the surrounding established areas and; <br /> <br />Whereas that the external effects of the proposal are not controlled considering compatibility of <br />land use to prevent the occurrence of nuisances and other factors deemed to effect public health, <br />welfare, safety and convenience. <br /> <br />We resolve that the Louisville Planning Commission denies the request of Special Review Use. <br />The Planning Commission recommends to the Louisville City Council that the Public Service <br />Company be allowed to utilize its legally obtained rights-of-way and easements as related to these <br />transmission facilities only according to existing legal entitlements. <br /> <br />Further the Louisville Planning Commission recommends that the Louisville City Council <br />negotiate with the Public Service Company to ultimately bury or relocate the existing facilities if <br />economically and technically feasible.” <br /> <br /> 7 <br /> <br />
