Commissioner Pritchard: – Support PSCo to build where the existing power line is. Not sure it
will help to continue the discussion.

Chairman Lipton – Agrees with Chris Pritchard to a certain extent. We need to be balanced in
how we approach this. PSCo does have certain vested rights to use the right-of-way they already
have. Also feel that they can’t go in and upgrade without city approval. Perhaps cost should not
be the cheapest. Do not believe they meet SRU criteria. Perhaps request staff to draft denial for
the January meeting

Commissioner McDermott – frustrated with all we have been provided. We are missing data that
has transpired during this whole process. We either continue with an understanding that all
information be provided or follow the line of reasoning to deny the application.

Commissioner McAvinew – Ask for a split out of the operation/maintenance of above ground and
underground. Not hopeful of what will come out of PUC hearing. Hopes that Xcel/PSCo will
improve their long term planning, this is what needs to happen.

Commissioner Lipton – We should restate the intent on the original findings, evaluations and
recommendation to continue to consider alternatives. We need to look at the economic impacts
on the immediate neighborhoods.

Commissioner Leh – Good idea to revise resolution to reflect additional process and finds since
the original Resolution #12.

Commissioner Kalish – We need to get rid of the burial discussion and add in the recommendation
on the alternative routes.

Commissioner Leh moved to continue the resolution to consider an updated resolution of denial,
reaffirming Resolution #12. Commissioner Kalish seconded.

Roll Call Vote: Commissioner Pritchard – No; Commissioner McDermott – No; Commissioner
Leh – Yes; Commissioner McAvinew – Yes; Commissioner Kalish – Yes; Chairman Lipton –
Yes.

Motion passed.

Resolution No. 52, Series 2000
, Preliminary plat and preliminary PUD development plan for
an office/warehouse/manufacturing development, Dillon Center, on the north side of Dillon
Road and 300 feet east of the Pierce Avenue intersection. Case # 00-39-PS/PP

Staff Public Notice Certification:

14
