Case #00-060-FS/RW. <br /> <br /> <br />Applicant & Owner: Chip Pancoast & Susan McEachern <br /> <br />Public Notice Verification: <br /> <br />Paul Wood, Planning Director, reported that the notice was published in the Daily Camera on February 27, <br />2001 and posted in City Hall and mailed to adjacent property owners on February 26, 2001. <br /> <br /> <br />Staff Report of Facts and Issues: <br /> <br />Wood reported the request as a minor subdivision plat and alley right-of-way vacations to create two <br />residential lots from three existing lots and a part of a fourth lot. The subject property is located at the <br />northwest corner of Roosevelt Avenue and Aspen Way. The property was originally platted in 1890 and is <br />zoned RL. A single family home was recently constructed on proposed Lot 2A. The other lot will be held <br />for a single family home. <br /> <br />As part of the subdivision request, three public alley rights-of-way are requested to be vacated. At the west <br />end of Lot 15, two alleys have been dedicated to the City by deed. An alley right-of-way running along the <br />northern portion of Lots 12-14 is also proposed to be vacated. Questions have arisen regarding the <br />dimension of the north alley and whether portions of the alley may have been vacated through previous plat <br />actions, therefore the Staff is recommending the north alley vacation request be removed from the <br />subdivision action. If the applicant wishes to pursue the request further, additional survey and legal <br />documentation will need to be provided, and the request will need to be coordinated with other affected <br />property owners. <br /> <br />Staff finds the application complies with the City’s zoning and subdivision regulations. Staff recommends <br />approval of the minor subdivision replat and of the right-of-way vacations for the public alleys that run <br />north/south across proposed Lot 1A. Staff is not in support of the request for vacation of the east/west alley <br />along the north side of the subdivision.
